노사의 제도와 규제 작성자로의 역할 전환에 관한 역사적 고찰:사회협약의 입법과정을 중심으로

Abstract

이 연구는 노ᆞ사의 역할이 제도와 규제 수용자에서 어떻게 작성자로 전환됐는지 역사 적으로 고찰했다. 전략적 선택과 사회적 학습의 분석 틀을 바탕으로 1998년 사회협약 입 법체계가 형성되면서 노ᆞ사의 역할이 제도와 규제의 작성자로 전환됐음을 규명했다. 사 회협약 입법체계는 노ᆞ사 대표단체와 정부가 합의한 사회협약을 기초로 의회에서 법률 제ᆞ개정안을 처리하는 비공식적인 규칙이자 제도를 의미한다. 본 연구는 과정추적 방법 에 의한 사례분석을 바탕으로 사회협약에 관한 노사정 논의와 연계된 15대 국회 환경노 동위원회의 입법과정을 연구했다. 네오 코포라티즘의 조직적ᆞ제도적 전제조건 없이 사회 적 행위자들이 1998년 사회협약 입법체계를 형성한 것을 확인했다. 전략적 선택의 작용 은 노ᆞ사ᆞ정과 정당들이 공통적으로 정책결정 일방주의 대신 사회적 협의와 협력입법을 결정한 점에서 확인됐다.

국가 수준의 노ᆞ사ᆞ정과 정당들은 사회협약을 매개로 사회적 협의와 정당 간 협의를 거쳐 개혁입법을 이뤄냈다. 1~2기 노사정위원회는 15대 국회 후반기 동안 100개의 합의 조항으로 구성된 10건의 사회적 합의를 도출했다. 집권정당과 야당은 15대 국회 환경노 동위를 거쳐 본회의를 통과한 노동법률 46건 가운데 12건(26%)의 사회협약 관련 법안을 처리했다. 이처럼 본 연구는 국가 수준에서 노동조합과 사용자측이 사회적 협의와 국회 입법과정에 참여해 공공정책을 형성한 것을 서술했다. 이 연구는 기업과 노동조합, 연구 자들이 국가 수준의 노사관계와 국회의 입법과정을 종합적으로 이해하는데 기여할 것으 로 기대한다. 무엇보다 이 연구는 네오 코포라티즘의 전제조건 없이 사회협약 입법체계 형성을 설명한 전략적 선택과 사회적 학습 분석 틀의 유용성을 입증했다는데 이론적 의의가 있다.;Based on the analysis framework of strategic choice and social learning, the study analyzed the social pact and legislative process in 1998 and found that the roles of management and unions were transformed into authors of systems and regulations as the social pact legislative system was formed. This paper studied the legislative process of the 15th National Assembly’s Environmental and Labor Committee in connection with discussions on social pacts based on case analysis by process tracking method. The action of strategic choice was confirmed in that the labor union, employers’association, and the government and political parties commonly decided on social concertation and cooperative legislation instead of policy-making unilateralism.

This study has theoretical significance in that it proved the usefulness of the analysis framework of social learning and strategic choices that explained the formation of a legislative system for social pacts without prerequisites for neo-corporatism in Korea.
