인터넷상의 음란물 유포죄에 대한 한국과 중국 비교연구

Abstract

Recently the attitude of sex in present Chinese society becomes open gradually, obscene object overflow seriously. Cartoons, pictures, novels etc. which related to male and female sex are propagated far and wide, as China is have the biggest internet users in the world. The problem of obscene object propagation in China is entered to public field since 2000. However the same problem in Korea is started in 1970. So the concept about obscene object is substantiated, which can prevent its spread through internet. But the case in China is totally different from Korea. In China, since the internet was widely used, it is used for obscene object dissemination. The punishment was happened before the law establishment. Because of that, the technique of government is just ban and penalty. Since China and Korea are two countries which have the similar culture but different social community organization, this article is concentrated on the law and rules related to prurience in the two countries. At the same time, specific cases was analysed for the investigation of punishment in two countries.
