공공역사 구술자료 활용과 법적/윤리적 쟁점 : 북미 사례를 중심으로

Abstract

본 논문은 북미 구술자료 활용에 관한 윤리적 쟁점에 관한 사안을 다룬다. 구술사 연구가 공공역사의 자료로 활용되고 대중과의 접합점을 확대해가면서 구술사적 자료 수집과 활용을 둘러싼 윤리적, 법적 문제는 점차 중요한 문제가 되어가고 있다. 이 문 제에 대한 논의를 활성화시키기 위하여 본 논문은 북미 사례를 중심으로 구술자료 활 용에 대한 윤리 및 법적 쟁점을 살펴보고자 한다. 본 논문은 북미 지역에서 찾아 볼 수 있는 구술사적 자료 활용에 관한 3가지 윤리 적 쟁점인 피해자 중심 접근법, 탈식민 아카이브, 권력구조 비판을 사례와 함께 성찰 하고자 한다. 그리고 구술자료 활용과 관련하여 미국은 물론 한국에서도 중요한 법적 쟁점이 될 수 있는 1) 구술자료의 강제공개, 2) 명예훼손, 그리고 3) 인터넷 환경에서 의 구술자료 활용을 논의하고자 한다. 이를 통해 북미의 사례와 관련된 구술사 연구의 법적 윤리적 쟁점을 반면교사 삼아 한국의 구술사 연구에서 관련 논의가 활성화되기를 바란다. This paper examines various ethical issues related to the applications and usage of oral historical materials in North America. As oral history is more and more associated with public history and popularized, ethical and legal issues regarding the collection and use of oral histories are becoming serious and complex. In order to stimulate serious discussions on these issues, this paper examines ethical and legal issues related to the use of oral historical materials in North America. This paper examines 3 ethical issues on the use of oral historical materials found in North American such as victim centered approach, de-colonial archive, and critique of power structure and reflects corresponding cases. Next, the paper discusses major legal issues related to the application and use of the oral historical materials found in the U.S. and South Korea in the near future: 1) compelled release of interviews, 2) defamation, and 3) oral history and the Internet. In doing so, this paper seeks to contribute to the preparation of sound ethical and legal understanding and practices regarding the application and use of oral historical materials.
