공공계약의 유형별 계약금액 조정에 대한 사례 연구

Abstract

Recently, due to global warming and changes in construction practices, risk are increasing in the construction industry. In order to minimize legal conflicts and social costs, This study investigated the public cost adjustment system and laws and analyzed cases of actual adjustment requests to the Public Procurement Service. As a result of the investigation, it was confirmed that the recent cost adjustment claim trend has increased due to the impact of climate change, demands for the enhancement of contractor rights and requests, response to Conora Crisis. The principles of the public contract mediation system are the mutually equal rights relations, application of the same standards, and burden on the person responsible for the change of the contract. I hope that this study will help cost adjustments related dispute resolution and construction industry development |최근 지구 온난화로 인한 급격한 기후변화로 건설산업 분야에 있어 공사기간, 품질·안전관리 등에 대한 위험 변수가 증가하고 있으며 이로 인한 공기 지연, 간접공사비 발생, 물가 상승으로 인한 비용 증가와 함께 설계시공일괄입찰 방식 등 공사 수행방식의 변화에 따라 공기 증가 및 설계 변경 요인이 대폭 증가하고 있다. 국가나 지방자치단체를 계약 주체로 하는 공공계약에 있어서 이러한 건설 산업 변화에 대응하여 관련 법규와 시행규칙에 근거하여 계약변경을 통한 금액 조정의 제도를 운영하여 이에 대처가 가능하나 민간 공사에 있어서는 이러한 계약적 근거가 없는 경우가 대부분으로 위험요인과 제반 비용을 계약 업체가 모두 부담할 수밖에 없는 형편으로 이로 인한 법적 분쟁이증가하고 있는 실정이다. 본 연구에서는 법률에 근거한 국가를 당사자로 하는 공공계약의 계약금액 조정 관련 선행 연구를 통해 공공계약에 조정 제도 및 관련 법규에 대한 이론적 고찰을 실시하고 계약 조정 사례를 조사, 분석하여 이러한 분쟁을 최소화하고 계약 조정 업무에서 실제 적용 가능한 대응방안을 도출하고자 하였다. 사례 조사 범위와 방법은 공공계약의 계약금액 조정 관련 조달청 홈페이지공개된 자료를 바탕으로 물가변동에 의한 계약금액 조정, 설계변경에 따른 계약금액 조정, 기타 계약 내용 변경으로 인한 계약금액 조정 사례 45건에 대해 조사를 실시하였다. 조사한 내용을 바탕으로 최근 계약 조정 사례 경향을 정리하였고 사례조사를 통해 도출된 계약조정 제도의 대원칙을 3가지로 정리하였다. 최종 결론에서는 공공계약 조정 청구시 실무에서 적용 가능한 대응원칙 및 개선방안을 구체적 항목으로 정리하였다.
