통신방송 네트워크의 융합과 규제정책 방향

Abstract

본 연구는 최근 발생하고 있는 네트워크 측면의 통ㆍ방융합의 현상을 통신사업자와 방송사업자의 상호 진입 측면에서 소개한다. 또한 미국, 영국, 일본 등 주요국가에서 네트워크 융합을 가능케 해 준 상호 진입 관련 법률체계와 규제 과정을 살펴보고 최근 EU 및 OECD의 논의 등을 바탕으로 우리나라의 규제정책에의 시사점을 도출하였다. 네트워크 융합 활성화를 위한 정책 방향으로 첫째, 전송망의 발전을 촉진하는 정책의 수립, 둘째, 네트워크과 콘텐츠의 규제 분리, 그리고 마지막으로 신규서비스에 대한 비규제 등을 제시하였다. 즉, 서로 다른 네트워크 간의 경쟁으로부터 망 고도화와 신규서비스의 빠른 도입이 가능함을 지적하였고, 네트워크에 대한 규제와 콘텐츠의 규제를 분리시킴으로써 다양한 통방융합적인 서비스의 진입이 가능함을 주장하고 있고, 마지막으로 신규서비스에 대해서는 기술발전의 촉진을 위하여 일시적 비규제가 필요하다고 주장하고 있다. This research introduces recent phenomena of telecommunications-broadcasting convergence from a viewpoint of cross entry between telecommunications carriers and broadcasters. Also, it reviews the law and regulatory framework regarding cross entry in US, UK and Japan, which made the network convergence possible. This paper asserts that we need the following policies: first, a policy which facilitates the development of the carriage network, second, a separation of network and contents regulation, and third, the temporary unregulation of new services. That is, it is asserted that the network development and introduction of new services are possible from the competition of two different networks, that is, telecommunications and cable networks. Also, the authors suggest that various convergence services can be introduced from the separation of network and contents regulation; and for the rapid development of technology, temporary unregulation is needed.
