國·公有地의 效率的 管理方案에 관한 硏究

Abstract

한국은 國土 면적이 좁고 人口 密度 또한 높아 국토의 效率的인 관리는 必須不可缺하다. 그럼에도 불구하고 국토의 效率的인 관리가 사실상 어려웠던 것은 日帝 强占期 등 역사적인 배경이 있었다. 해방이후 國公有地 관리와 관련한 여러 제도의 변화가 있었지만 소극적인 維持·保存 爲主에서 脫皮하지 못하고 있어 國·公有地의 활용도가 저조한 수준이며, 또한 방치하거나 無斷 占有하는 事例가 상당히 많았다. 따라서 國·公有財産의 效率的인 관리를 위해서는 行政環境이나 管理側面에서 많은 부분의 개선이 필요하다. 이에 본 論文에서는 국·공유재산 관리의 效率的인 관리를 위한 국공유지 관리조직과 관리방식 및 활용을 위한 제도적 방안을 마련하고 이를 바탕으로 國公有地의 적극적 活用方案을 제시하는 것이 본 연구의 목적이다. 이 연구목적을 수행하기 위하여 문헌연구와 사례연구 등의 방법으로 연구를 진행하였다. 국공유재산 관리와 관련한 硏究論文과 單行本, 정부의 統計資料를 기초로 이론적 검토와 현황 분석을 하였다. 사례연구는 선진외국의 국·공유재산 관리현황과 문제점을 分析하는데 초점을 두고 先進事例의 도입 가능성을 檢討하였다. 그 내용을 정리하면 다음과 같다. 첫째, 管理組織體係上의 總括機能의 强化 둘째, 관리 인력의 專門化 및 업무능력 향상 셋째, 專門性과 收益性이 요구되는 분야에 대한 民間委託管理의 확대 넷째, 정보연계 전산시스템 구축 및 日本人名義 土地와 隱匿·無主 不動産 및 무단점유자 색출 다섯째, 國·公有不動産의 활용 活性化를 위한 不動産信託開發 方式 導入 여섯째, 國·公有不動産의 交換·管理換·讓與制度의 합리화 및 효율적인 매각비축기능 강화 등의 制度改善 方案을 제시하였다. 각 제도별 改善方案은 서로 밀접한 관계를 가지고 있다. 따라서 각각의 제도를 단편적으로 개선할 것이 아니라 전체적인 시각에서 제도 전반을 정비한다는 차원의 접근이 필요하다. 國公有不動産 관리제도가 제대로 정비되어 의도한 바와 같은 실효성을 거두기 위해서는 각각의 개선방안이 적절히 상호 連繫되어 전체로서의 體系를 갖추어야 한다. 또한 본 연구에서 그 동안 국공유부동산의 效率的인 관리가 사실상 어려웠던 역사적인 배경 등으로 인해 오랫동안 누적되어 왔던 문제점들을 해소하고 주변여건에 能動的으로 대처하기 위해서는 현 시점에서 보다 根本的이고 과감한 制度改善의 노력이 요구되며 나아가 國公有地의 運用 및 管理에 대한 심도 있는 問題 提起를 통한 改善方案 發掘 등 未來指向的 觀點에서 지속적인 硏究가 있어야겠다.; For Korea, effective management of the government-owned is indispensable due to its small size and high density of population. Nevertheless, it had been difficult under the conquest of Japan. Although, there were small changes after the liberation from Japanese control, the public land was still being managed poorly, not being able to get rid of the passive and conservative policy. Also, there have been many cases that the land was abandoned or illegally occupied by individuals. Therefore, it is necessary to improve many parts in administrative policies for the effective management of the public land. The purpose of this thesis is to provide the solutions to the organization for the effective management and the policy for the practical usage of the land. In order to achieve the purpose, the study has been proceeded based on many case studies and researches of other documents. While focusing on analysis of the benefits and problems in managing the public land in other advanced countries, the case studies support the possibility of adapting the cases in other countries. The contents are following: First, the reinforcement of the administrative organization functions Second, the improvement of the managers' specialty and work ability Third, the increasement of public trust management in areas that need specialty and profitability Forth, the establishment of information system, searching out Japanese named places and illegal lend holders and abusers Fifth, the introduction of real estate development policy for practical usage of the public land Sixth, the induction of the improvement program for effectively exchanging and transferring the control of the public land Each plan is closely related, and so, it is necessary to maintain the whole system together rather than struggling to improve each step separately. In order for the public land management to achieve the effective results as it is planned, it is important to prepare the interrelated program that improve the plans as a whole. In order to actively solve the historic problems that has made it difficult to manage the public land effectively, the more determined plans and efforts are required. Furthermore, continuous researches on future-focused improvement plans are necessary for the effective management and the practical usage of the government-owned land.
