개발제한구역 해제구역에 관한 관리방안연구

Abstract

본 연구는 경기도 광명시, 안산시, 시흥시, 과천시 등을 중심으로 개발제한구역에서 제1종 지구단위계획구역으로 우선해제 되는 중규모 집단취락지역에 대하여 해제취지에 맞지 않는 일부 관계법령의 문제와 제1종 지구단위계획 수립지침 및 운영상의 문제점 등에 대하여 사례를 중심으로 연구하고, 개선방안까지 제시 하여 보았다. 특히 개발제한구역에서 제1종 지구단위계획으로 우선해제 되는 중규모 지역에서 운영되는 제1종 지구단위계획구역 지침내용에 대하여「국토의 계획 및 이용에 관한 법률」과 「건축법」과의 상충되는 문제, 지침내용 오류, 해석의 차이 등으로 운영상 나타난 문제점 등에 대하여 사례를 중심으로 연구하여 보았다. 관계법령과 국토해양부의「제1종 지구단위계획 수립지침」의 문제점 등을 검토하여 합리적인 개발제한구역 해제지침이 되도록 연구하였고, 지역 현황과 지역주민의 입장에서 제1종 지구단위계획수립이 되도록 하여야 한다는 취지를 살리도록 개선방안을 제안 하였다. 개발제한구역에서 해제되는 중규모 지역의 경우「국토의 계획 및 이용에 관한 법률」제65조(개발행위에 따른 공공시설 등의 귀속) 전단부분 제2항 “개발행위허가를 받은 자가 행정청이 아닌 경우, 개발행위허가를 받은 자가 새로이 설치한 공공시설은 그 시설을 관리할 관리청에 무상으로 귀속되고”의 내용은 법령을 원칙대로 적용하기에는 많은 민원이 발생되는 현실을 감안하면 제1종 지구단위계획지침상에서라도 기반시설 설치에 대한 사업시행주체를 명확히 해야 한다는 것 등을 제안 하였다. 개발제한구역 중규모 해제지역에서 제1종 지구단위계획구역으로 해제되는 과정 중, 가장 민원발생 빈도가 높은 ‘개발행위허가’운영단계는 물론이고, 제1종 지구단위계획 작성을 위한 용역단계와 해제 이후의 사후관리까지의 과정에서 발생하는 문제점을 찾아 개선방안을 제안함으로서 제1종 지구단위계획구역(개발제한구역 중규모 해제지역) 지침작성의 올바른 방향을 제시하고자 하였다. 또한, 행정관청 입장이 아닌 개발제한구역에서 재산권 행사 제약을 받아온 주민의 입장에서 개선점을 파악하고 반영하여, 개발행위 운영단계에서 발생하는 많은 민원을 해소 할 수 있는 기회가 될 것이다.; The purpose of this study is to address the problems of law provisions, guidelines for development plans and operation of zones involving the development limited zones deregulated for the first-class unit planning zones and suggest their solutions. For this purpose, the development limited zones deregulated in Gwangmyong-si, Ansan-si, Siheung-si and Gwacheon-si were sampled. In particular, the researcher focused on the middle-scale villages in the development limited zones deregulated for the first-class unit planning zones to address the problems of the conflicting provisions between "National Land Planning and Using Act" and "Building Act" surrounding the guidelines for the first-class unit planning zones, erroneous guideline contents and differences of their interpretations, centering around the cases. To this end, the researcher examined the problems of "Guidelines for the First-Class Unit Planning Zones" published by Ministry of Land, Transportation and Maritime Affairs and suggested their solutions to the effect that the first-class unit zones should be planned in consideration of local conditions and people's interest. In case of the middle-scale villages deregulated from the development limited zones, Paragraph 2 of Article 65 (Attribution of Public Facilities, etc., due to Development) specifying "The public facilities installed anew by other developers permitted than an administrative agency shall be attributed free of charge to the administrative agency in charge of their management" has caused civil complaints too frequently to be applied intact, and therefore, it was suggested that the developers responsible for installation of the basic facilities should be clearly specified even in the first-class unit planning zone guidelines. In all, this study suggested some correct directions for the guidelines for the first-class unit planning zones (deregulated from the development limited zones) for the middle-scale villages by not only addressing the problems at the stage of 'permit for development' or the stage when the civil complaints had occurred most frequently for the middle-scale villages deregulated for the first-class unit planning zones but also identifying the problems occurring at the stage of the research outsourcing and even at the stage of post-deregulation. If the problems should be well addressed from the perspective of the people who have suffered from their limited property rights, not in view of the administrative agencies, various civil complaints occurring at the stage of operating the development projects would be much resolved.
