시스템 다이내믹스를 이용한 공기지연 클레임 분석

Abstract

건설공사에는 피하기 어려운 불확정적인 요소가 내재하고 있기 때문에 공사의 시공과정에 있어서 당초 예견 불가능한 현장의 시공 상황이 나타나거나, 설계도나 시방서에 미비한 부분이 발견되거나, 또는 발주자나 도급자 사이에 계약도서의 해석상의 차이가 발생하는 경우가 있다. 이러한 제반사항은 필연적으로 건설공사에 대한 클레임이나 분쟁의 잠재요인으로 작용하게 된다. 클레임은 사전적 의미로서는 '당연한 권리로서 손해배상을 요구하는 것'인데, 일반적으로 클레임이란 이의신청 또는 이의제기로서 계약상의 양쪽 당사자 가운데 어느 한쪽이 일종의 법률상의 권리로서 어떤 계약 하에서 혹은 계약과 관련하여 발생하게 되는 제반문제에 대해서 금전적인 지급을 요구하거나 계약조건의 조정 및 해석의 요구와 그 밖의 다른 구제조치를 요구하는 서면청구 또는 주장을 말한다. 문헌조사를 통하여 공기지연 클레임의 정의와 종류를 고찰하고 그에 관한 이론을 체계적으로 정리하고 시스템 사고를 이용한 시스템 다이내믹스 인과지도를 작성하여 공기지연 클레임의 문제점에 대한 원인을 분석한다. 분석된 문제점의 원인을 해결하여 국내 공기지연 클레임 개선을 위한 개선방안을 제시한다. 따라서 본 연구는 기존의 계층적인 계획프로세스 모델에 시스템사고의 인과지도를 이용하여 실제의 전체 공정표상에서 각각의 지연사건이 미치는 영향을 명확하게 보여주는 공기지연 분석방법을 제시하고자 한다.; Due to the unpredictable factors inherent in construction projects, unaware situations, inadequate parts in the blueprint or specifications, and differences in understanding of contracts between the contractor and owners often arises. These potential factors might lead to a construction claims or disputes. Recently there are many contract claims, which are caused by duration delay, in construction industry. Many kinds of research for solving such duration delay problem are being progressed and an effective computerized system needs to improve it. We established the definition of construction delay claim and through literature review, organized the theory, and analyzed the cause of trouble by drawing system dynamics. Lastly, we suggest a political improvement method for solving domestic construction delay claims. This study suggests an improved methodology and necessary functions to make a time impact analysis system.
