사법권력 강화가 갖는 정치적 동학과 자유민주주의체제의 안정성: 한국에서의 사법부 위상변화에 대한 통섭적 접근

Abstract

민주화 이후 한국의 사법부는 지속적으로 그 역할이 강화되어 왔고, 그 결과 현재에는 중요한 권력 행위자로 그 위상이 변화되었다. 본 논문은 권력 강화의 기본적인 조건이라 할 수 있는 지지세력과 조직을 갖추고 있지 못하다는 사법부의 구조적 제약요인에도 불구하고 어떻게 강력한 힘을 가지게 되었는지에 대해 이해하기 위해, 이론적 분석틀로서 사법권력의 특징, 사법권력의 한계 등을 살펴보고 자유주의적 관점에서 사법부 강화 현상을 분석하고자 했다. 본 연구는 기본적으로 사법부의 확대가 자유 민주주의를 증진시키는데 필수적이라고 가정하고, 사법부 권력 강화에 대해 기존의 단일국가 중심의 분석에서 한국과미국 간의 비교연구를 수행함으로써 현실정치영역에서 사법부 강화가 어떤 영향을미치고 어떤 관련성과 의미를 가지는지를 추적하였다. 특히 정당성 논쟁을 중심으로 한 갈등관계 분석을 시도함에 있어서 대표된 권력인 행정부?입법부의 권력과, 대표되지 않은 권력인 사법권력 간 정당성 논쟁, 뿐만아니라 자유주의와 공화주의, 민주주의와 헌정주의, 사법소극주의와 사법적극주의등의 긴장 관계를 중심으로 분석하였다.The role of judicial branch has increased since the democratization of Korea and consequently, become a major counteractor toward other branches. This paper analyses the strengthening process of judicial branch based on liberal point of view through dealing with the features and relative limits of judicial branch comparing to other branches in terms of lacking constituents and organization. the basic assumption of this paper is that the expansion of judicial branch is necessary to promote liberal democracy. This paper takes comparative method using two countries such as Korea and the United States system to verify how this changes affects and evolves in practical political domain. The tension between other branches such as executive and legislature, liberalism and republicanism,democracy and constitutionalism, judicial activism and judicial restraint will be elaborated.
