관광산업 진흥을 위한 관광숙박업 개념에 관한 연구 - ‘서비스드 레지던스’를 중심으로 -

Abstract

숙박업은 공중위생관리법의 규율을 받는 업종의 하나이다. 또한 숙박업은 기본적 상행위인 공중접객업의 하나 이기도 하다. 숙박업은 곧 상행위이자 공중위생의 규율대상이다. 산업 진홍을 위하여 규제가 완화될 수 있다. 규제 완화 차원에서 숙박업의 종류도 정하고 있지 않을 뿐 아니라 숙박업에 대한 기준 조차 없앴다. 그렇게 했더니 새로운 업종이 나왔다. 그 중 하나가 서비스드 레지던스이다. 이제 와서 규제하려 하니 이미 상업지역과 주거지역에 상관없이 존재하고 있다. 단순하게 규율할 수 없는 처지에 이른 것이다. 나날이 비즈니스의 규모가 변화하며 확대됨에 따라 여러 법률문제를 야기하고 있다. 이처럼 이론과 현실의 차이가 발생하는 이유는 현실적인 필요성이다. 복합적인 성격을 갖고 있는 숙박업에 대한 진흥 정책과 공중 보건위생의 효율성과 실효성 확보를 위한 기초적인 연구로서, 서비스드 레지던스를 포함하여 숙박업과 관련한 계약의 성격과 규범에 대해 관련 법 규정을 분석하고 연구할 필요가 있다. 이를 위해 숙박업과 관련한 현행 법령에 대한 실증적 분석이 이루어져야 하겠다. 즉, 관광산업의 진흥과 공중위생에 맞는 숙박업과 관련한 현행 법령에 대한 실증적 분석이 이루어져야 하겠다. 즉, 관광산업의 진흥과 공중위생에 맞는 숙박업과 관련한 현행 법령에 대한 실증적 분석이 이루어져야 하겠다. 즉, 관광산업의 진흥과 공중위생에 맞는 숙박업의 법적 개념 및 세분류의 명확화와 관련 법령간의 관계 재정립을 위해 숙박업 관련 법령의 현황을 정리할 필요가 있다. 이에 따라 본 연구의 목적 및 결과는 다음과 같다. 첫째, 서비스드 레지던스를 중심으로 숙박업에 대한 각 법령간 내용을 비교하면서 우리나라 숙박업에 대한 명정한 법적 의미를 제시하려 하였다. 둘째, 숙박업의 구체적인 세분을 통하여 숙박업이 발전해 나갈 수 있는 방안을 제시하였다.Tourism lodging business is ruled by the law of public health. Also, the lodging business is basic business activity of the service trade. Lodging business is the regulation object of public health and the regulation can be moderated for promoting business. As an aspect of deregulation, there are no types of lodging business and no standards of it. In so doing, new business showed up. Regulation is not everything. As the scale of business has changed and expanded, the legal problems has showed up. The reason of gap between theory and real world is the practical necessity. For promoting policy of lodging business which has complex features and the efficiency and effectiveness of public health, features of contracts and norms regulations which are related lodging business including serviced residence are needed to study. For this, the practical analysis should be conducted including lodging business legislations. That is, for the legal concept of tourism lodging business and the clear classification and reestablishment of related legal regulations, it is needed to arrange current state of related regulations. So, the aims and results of this study are followed. First, we tried to suggest clear legal meanings of domestic lodging business comparing contents of legal regulations based on serviced residence. Second, through the practical classifications of lodging business, we suggested plans of lodging business development.
