투명성과 공익성: 바이오뱅크의 윤리적 쟁점

Abstract

바이오뱅크(biobank)는 생물체, 특히 인간으로부터 유래된 생체 시료를 체계적으로 관리하고 보관하여 의생명과학 연구 등의 목적에 활용할 수 있도록 돕는 체계(system)를 의미한다. 바이오뱅크는 그 목적상 인류복지에 도움을 주려 하기에 윤리적으로 별다른 문제를 제기하지 않는다고 생각될 수 있다. 이 논문에서 필자는 실은 바이오뱅크가 복잡한 윤리적 문제와 관련되어 있으며 이 문제에는 인지동의(informed consent)를 포괄적 동의(broad consent) 등의 형식으로 윤리적으로 합당하게 확장하는 문제처럼, 오래된 문제가 새로운 양상으로 나타나는 경우와 유전정보에 근거한 정체성 정치(identity politics)의 위험처럼 새롭게 제기되는 문제가 복잡하게 얽혀 있음을 보일 것이다. 그런 다음 이런 문제를 해결하기 위해서는 바이오뱅크의 설립과 운영 과정에서 투명성(transparency)과 공익성에 입각한 적절한 관리 체계를 갖추는 것이 반드시 필요하다는 점을 논증한다.A biobank is a research-facilitating system where biological samples derived from organisms, especially humans are collected, stored and managed for future biomedical studies. Despite its ultimate goal to promote human welfare, biobanks, especially the large-scale ones which are recently popular worldwide, confront a number of ethical problems to require careful considerations. Those problems include the variations of old problems such as how to modify the concept of ``informed consent`` in the context of biobanks, and rather novel challenges such as the danger of identity politics based on a wrong idea of genetic information. I will argue that transparency and concern for public interests should be the cornerstones of the governance structure of biobanks in order to deal with the problems in a ethically justified way.
