Abstract
사회보장정책의 내용과 특성은 그 사회가 직면한 사회적 위험에 의해 결정된다. 즉 사회의 구조적 변화는 사회보장정책과 법의 유형과 특성을 결정짓는다. 한국사회에서도 마찬가지이다. 최근 한국 사회의 구조적 변화는 1997년의 외환위기를 기준으로 설명하는 견해가 많다. 외환위기 전에는 한국이 복지국가인가가 관심이었다면 이후에는 어떻게 복지국가를 할 것인가에 관심이 있다고 말할 수 있을 정도로 외환위기는 한국에서 복지개혁의 시발점으로 평가되고 있다. 외환위기 이후 한국 사회의 구조적 변화로는 세계화 및 그 이념적 기반이 되는 신자유주의와 후기산업화사회의 두 가지로 요약할 수 있다. 신자유주의와 후기산업화사회로 인한 영향은 상호보완적 관계에 있다. 신자유주의는 사회보장체제에서 민영화, 시장화, 각종 규제의 철폐와 계약의 활성화 또 그로 인한 노동시장의 유연화 등을 가져왔다. 후기산업화사회는 제조업에서 서비스업으로의 고용구조 변화에 따라 고용불안과 고용의 질적 하락을 가져왔으며, 고령화, 핵가족화, 여성인구의 증가 등과 같은 가족 구조의 변화도 가져왔다. 이러한 사회구조의 변화는 사회보장정책에 영향을 미치게 되는데, 그 대표적인 것이 신자유주의에 이념적 기반을 둔 생산적복지 등의 제도이다. 김대중 정부의 자활지원사업 등을 통한 생산적 복지는 노무현 정부에서는 사회투자국가이론을 통한 참여 복지, 이명박 정부의 근로장려세제를 통한 능동적 복지 등으로 발전해 가는데, 모두 근로연계복지를 강조하는 것이어서 그 이념적 기반에는 큰 차이가 없다. 후기산업화로 인해 발생한 신 사회위험(new social risk)의 대응으로서는 보편주의의 채택 및 사회서비스의 제공을 요구한다. 김대중 정부 이래 국민연금, 고용보험, 산재보험 등은 적용범위 확대를 통한 보편주의를 취하였으며, 국민연금과 건강보험은 재정을 통합함으로써 사회연대를 확대하였다. 그런데 생산적 복지 등으로 시행한 근로연계복지의 경우 빈곤율이나 탈수급율 등 수급혜택의 측면에서 크게 개선된 면을 보이지 못하고 있다. 비정규직 근로자 등 근로빈곤층은 여전히 사각지대로 남아 있다. 또 보편주의가 확대된 사회보험의 경우에도 납부예외자나 적용제외자가 광범위하게 존재하여 사회안전망으로서의 기능을 충실히 수행하지는 못하고 있다. 생각건대 사회보장체계가 좀 더 관심을 두어야 점은 사각지대로 남아 있는 비정규직과 영세 자영자에 대한 보호이며, 사회보험을 제1차적 안전망으로 하는 보편주의적 사회보장체제를 견지할 수밖에 없다. 중간계층이 빈곤에 빠지지 않도록 예방하는 것이 사회전체의 입장에서 더욱 중요하기 때문이다. 최저수준의 사회보장은 국가의 책무로 하고, 최적 수준의 사회보장은 민간과 협력하는 역할 분담이 필요하다.The contents and characteristics of social security policy is determined by the social risks that society is faced. Or The structural changes in society will determine the type and characteristics of the social security policy and the law. The same is true in Korea society. The 1997 financial crisis is the turning point of Recent structural changes in Korea society. The financial crisis in South Korea are regarded as the starting point of welfare reform. As the structural changes in society since the financial crisis in South Korea, globalization or the neo-liberalism and post-industrial society and the like. The Relationship between neo-liberalism and post-industrial society are complementary. Neo-liberalism in the Social Security system have brought privatization, marketization, the deregulation and activationof contract and in addition, the resulting flexibility of the labor market. Post-industrialized society have brought, changes from manufacturing to services depending on changes in the structure of employment and job insecurity brought about a drop in employment quality, aging, nuclear family, the increase of the female population, such as changes in family structure. These changes in the social structure affects the social security policy, The representative is the workfare which is neoliberalism. Neoliberalism has grown into Participation Welfare of Noh-MuHyun government through social investment state theory and Active Welfare of MB government through the EITC (Earned Income Tax Credit). All these are the ones that highlight the Welfare to Work. As Response to new social risks caused by industrialization, Universalism has been required. This phenomenon is mainly from social insurance, pension, public health insurance, workers` compensation insurance etc. However, Welfare to Work and adoption of universalism was not improved poverty rate, the working poor, such as temporary workers and small business owners still remains a blind spot. Those are to be solved recent pressing problems.
