자동차 분야의 NPEs 대응전략에 관한 연구

Abstract

최근, IT와 자동차 기술의 융합으로 자동차 부품이 전장화되고 있고, 컴퓨터 및 전자 분야에서 활동하던 NPEs도 자동차 분야로 진출하고 있는 추세이다. NPEs는 선행기술조사와 청구항 분석표(Claim chart)를 활용한 분석으로 특허분쟁 시 상대 기업의 기술 범위를 미리 파악하는 한편, 상대 기업이 소송 이전에 신속한 대응책을 마련하기 힘들도록 하는 공격 전략을 개발해 왔다. 자동차 제조 기업들은 경쟁사 동향 분석을 통해 크로스라이선스나 기술제휴 등의 전략으로 특허분쟁예방에 집중해 왔으나, 이러한 방법은 소송 및 협상을 통한 금전적인 보상을 목표로 하는 NPEs와의 특허분쟁에 대해서는 취약한 부분이 있어 이에 적합한 대응기법의 개발이 필요하다. 본 연구에서는 NPEs 동향을 효과적으로 파악함으로써 특허소송의 발생 이전에 선제적인 대응전략을 수립할 수 있는 방법을 제안한다. 제안된 방법은 NPEs 목록을 구축하고 현재 NPEs가 구축중인 특허 포트폴리오를 파악하는 것을 핵심으로 하며, 이를 통해 NPEs의 특허보유 및 매집 현황에 대한 모니터링이 가능하고 NPEs의 유형에 따른 소송 대응 전략을 수립하여 조속한 분쟁해결과 분쟁 관련비용을 감소시킬 수 있다. 본 연구는 자동차 분야를 중심으로 수행되었으나, 개발된 방법은 IT 및 전자 등 다른 분야에도 적용될 수 있다.Automotive technologies have fused with IT technologies recently to invite NPEs into the automotive industry. NPEs are known to study the technology scopes of the target companies and precedent technologies in advance to establish claim charts. Automotive manufacturers, who have been focusing on trend analysis of the competitors’ technologies to prevent patent disputes through crosslicensing and forming technology alliances, have less time to prepare adequate responses without systemized strategies against NPEs whose main business is claiming monetary compensation by raising patent disputes to leave little possibility of collaborations. The objective of this study is to propose a methodology to reproduce the patent portfolios of NPEs by back tracking for establishing effective and preventive counter strategies against patent disputes raised by NPEs. For the purpose, we suggest to build NPE list for monitoring patent accumulation status of NPEs. Our proposed method shows the possibility to resolve conflicts and reduce costs by rapidly identifying the types and the purpose of NPEs.
