지상파방송사업자와 유료방송사업자 간 방송 분쟁에 대한 법적 판단 기준에 대한 연구

Abstract

본 연구는 방송환경의 변화와 다가오는 디지털화로 인해 지속적인 분쟁이 발생할 것으로 예상되는 지상파방송사업자와 유료방송사업자의 방송 분쟁 중 시청자들의 수용자 복지적 측면에 가장 밀접한 연관이 있는 지상파 재송신의 문제에 대한 법적 판단 기준에 대해 분석하고자 하였다. 분석결과, 지상파 재송신 분쟁에서 법원의 가장 큰 판단 기준이 되는 개념은 ‘공중송신권’과 ‘동시중계방송권’이며, 그 중 ‘동시중계방송권’의 침해만 법원이 인정하고 있는 것으로 나타났으며, 저작권적 개념인 ‘공중송신권’에 대해서는 점차적으로 침해 범위를 좁혀가고 있는 것을 알 수 있었다. 한편, ‘동시중계방송권’의 경우, 유료방송사업자들의 침해행위가 해당되는 것으로 법원은 판단하고 있는 것으로 분석되었다. One of the serious issues between terrestrial-broadcasting providers and paid-broadcasting providers in fast changing broadcasting environment is the dispute in re-transmission. Both providers argue that retransmission disputes should be resolved for the sake of viewers’ welfare. However, it is extremely different for both to achieve this goal. With this understanding, this study examined how Korean courts perceive the re-transmission issue. For this, it analyzed what legal standards and principles the Korean courts have applied in resolving re-transmission related disputes. This study found out that according to cases, the courts used the right of public transmission and simultaneous relay broadcast as basic standards for the decisions. In the cases, the courts decided whether or not the re-transmission of the terrestrial broadcast programs by cable broadcasters is violation of the rights against the law. As a result, this study found out that both terrestrial-broadcasting and paid broadcasting providers have to make mutual efforts to resolve the re-transmission dispute because it is closely regarded with viewers' welfare.
