2012년 지적재산법 중요 판례

Abstract

지적재산법과 관련하여 상당수의 판결이 2012년도에 선고되었는데, 본고는 지적재산법 관련판결들 중에서 중요하다고 생각되는 것을 선별하여 대법원 판결을 중심으로 고찰하고, 하급심 판결은특별히 소개할 필요가 있다고 생각되는 경우에 한하여 예외적으로 검토한다. 본고는 전부 3개의 장으로 구성되어 있는데, 제1장은 서론이다. 제2장은 산업재산권법에 관한 것으로서 특허침해소송에서 무효항변의 문제를 비롯하여 일사부재리 원칙의 판단기준시점, ‘위치상표’의 판단기준, 상표침해소송에서 무효항변의 판단 등에 대한 판결을 분석?검토한다. 제3장은 저작권법에 관한 것으로서 저작권법 제29조제2항에서 정한 ‘판매용 음반’의 의미와 저작권 등의 비침해행위와 일반불법행위의 성립 등에 대한 판결을 분석?검토한다. 제4장은 결론이다.There are not a few decisions of Korean courts in 2012 which should be reviewed theoretically on the level of intellectual property law. Primarily, the objective of this paper is to examine and review judgements concerning intellectual property law rendered by the Supreme Court in 2012. On the particular occasion for need, exceptionally this paper reviews the lower court decision concerning intellectual property law. This paper is composed of four parts. Part I is the introduction. Part II points out some problematic cases with defense of invalidity of patent in infringement lawsuit, the principle of the prohibition of double jeopardy, position mark, and defense of invalidity of trademark in infringement lawsuit. Part III. reviews the cases regarding the meaning of ‘a phonogram published for commercial purposes’ in article 29 paragraph ii of copyright law, and non-infringing acts of copyright law. Part VI is the conclusion.
