입법부와 규제개혁: 우리나라 규제입법의 문제점에 대한 제도적 개선방안의 모색을 중심으로

Abstract

국회에 대한 국민들의 실망과 허탈감이 고조되고 있으며, 특히 국회의 가장 중요한 임무인 입법 활동의 수준과 내용에 대한 의구심이 팽배해 있다. 규제의 경우에도 특별한 예외는 아닐 것이다. 본 연구는 국회 입법 활동의 문제점들을 규제개혁의 차원에서 분석해보고 그 개선방안을 제시해보고자 하였다. 특히 국회가 생산하는 규제의 품질차원에 초점을 맞추고자 한다. 이를 위하여 헌법학의 차원에서 의원입법의 원칙에 대한 이론적인 규명을 한 후에, 우리나라 국회의 의원입법의 세부적인 과정과 절차를 살펴보고, 기존연구들에서 제기되었던 국회의 입법과 관련된 문제점들을 살펴본 후 보편적으로 제시되는 제도적 및 비제도적 해결 방안을 대응시켰다. 그 결과 의원입법규제에 대한 규제영향분석 도입의 필요성과 기대효과가 의원입법의 원칙에 상응함을 논증하였다. 이에 더하여 의원입법규제의 문제점들에 대한 대응방안으로서 규제영향분석을 중심으로 하는 제도적 및 비제도적 대안들을 연구의 함의로 제시하였다.The disappointment and despondency of Korean citizens about the National Assembly have been heightened, especially disbelief about the quality and content of the legislation, which is the most significant assignment of the National Assembly. The case of regulation will not be special exceptions. In terms of regulatory reform, this study tries to analyze problems of the legislation of the Korean National Assembly and to present institutional and non-institutional alternatives, particularly focusing on the quality level of the regulation. To do this, this study identifies the theoretical principles of the legislation based on constitutional studies, and scrutinizes the specifics of the process and procedures of the Legislative Assembly of the Korean National Assembly, and discusses the problems associated with the Legislative Assembly raised in previous studies respectively. After that, a common response was addressed as a non-institutional and institutional solution. Consequently, the introduction of necessity and expected effect of the regulatory impact analysis regarding the legislative regulation prove the corresponding argument on the principle of the legislation. In addition, this study proposes the implications of institutional and non-institutional alternatives as a method to respond to the problems of the legislative regulation.
