그린인터넷인증제의 문제점과 개선방안에 관한 연구 - 자율규제와의 조화를 중심으로 -

Abstract

인터넷중독 이슈는 한국 사회에서 인터넷이 보편화되고 일반화되면서 인터넷의 역기능 중의 하나로 끊임없이 제기되어 왔던 의제인데, 정부는 이와 관련된 입법이나 정책의 일환으로 2013. 5. 22. 국가정보화기본법의 개정을 통해 2013. 11. 23부터 소위 ‘그린인터넷인증제’를 도입·실시하고 있다. 그린인터넷인증제는 인터넷중독 예방 및 해소를 그 목적으로 인터넷사업자의 자율규제를 유도하기 위해 도입된 제도로 평가된다. 인터넷중독 예방 및 해소라고 하는 취지에도 불구하고 그린인터넷인증제의 법적 성격을 어떻게 파악해야 할 것인가의 문제, 그린인터넷인증제가 규제적 성격을 갖고 있지는 않은지의 문제, 한국 사회에서 적용되고 있는 인터넷 규제입법 내지 정책 전반에 있어서 그린인터넷인증제가 어떠한 위치 내지 의미를 가지고 있는지의 문제, 더 나아가서 그린인터넷인증제와 인터넷 자율규제가 조화될 수 있을 것인가라는 문제 등에 관한 의문은 여전히 남는다. 그린인터넷인증제에 관한 이러한 여러 가지 의문들을 바탕으로 이 글은 현행 국가정보화기본법이 채택하고 있는 그린인터넷인증제의 문제점을 살펴보고, 궁극적으로 인터넷 자율규제와의 조화의 관점에서 그린인터넷인증제의 개선방안을 제시하는 것을 목적으로 한다. 본 연구는 인터넷 사업자의 자율규제와 그린인터넷인증제를 조화시키기 위한 구체적인 방안으로 다음과 같은 것들을 제시하였다. 첫째, 그린인터넷인증을 받은 사업자에 대해서는 각종 법적 규제를 면제시키는 방향으로 그린인터넷인증제를 개선할 필요가 있다. 둘째, 그린인터넷인증의 기준 4가지 상호간의 관계를 조정할 필요가 있다. 셋째, 그린인터넷인증을 받기 위한 기준 충족에 필요한 비용 및 시스템을 정부가 지원해 줄 필요가 있다. 넷째, 인터넷 이용자뿐만 아니라 그린인터넷인증제의 수범자인 정보통신서비스제공자 등 관련 당사자들이 지속적으로 자신의 의견을 제시할 수 있도록, 인증기준 설정 및 변경절차를 공정하고도 개방적으로 구성할 필요가 있다.The issue of Internet addiction has been a burning one among dysfunctions of the Internet since the Internet became more common and universal in the Korean society. The Korean government is adopting and implementing so-called ‘Green Internet Certification System’ as one of policies concerning Internet addiction since Oct. 23. 2013. through May 22. 2013. revision of 「Framework Act on National Informatization」. The Green Internet Certification System is being analyzed as a tool to induce selfregulation of Internet service provider including game service provider with a purpose of prevention and alleviation of Internet addiction. There are still a few questions over how to analyze the legal characters of the Green Internet Certification, whether the Green Internet Certification is one of regulation, which position or meaning the Green Internet Certification has in the whole Internet regulation systems or policies in the Korean society, furthermore whether the Green Internet Certification can harmonize with Internet self-regulation, despite original intent of Internet addiction prevention and alleviation. Based on these questions, this study overviews the problems of the Green Internet Certification, finally aims to suggest a proposal for improvement of it in a viewpoint of Harmonization with Self-Regulation. This study is suggesting concrete proposals to harmonize the Green Internet Certification system with self-regulation of Internet service provider as follows. First, the Internet service provider which received a Green Internet Certification from government should be exempted from the concerned legal regulations. Second, the four standards of Green Internet Certification should be modified and adjusted for activating self-regulation by Internet service provider. Third, the government should support costs which are necessary for Internet service provider to satisfy the standards to receive a Green Internet Certification. Fourth, in standards setting or revising, so that the concerned parties can suggest their opinions continuously, the process should be set fair and open to Internet service provider as well as Internet users.
