문화예술법 서설 -문화예술법제의 범주, 연구현황 및 연구방향-

Abstract

문화법, 예술법 혹은 문화예술법은 근래에 들어 학계에서 자주 회자되는 것이기는 하지만, 구체적으로 그러한 법분야가 무엇을 다루는 것인지, 또한 어떠한 주제들을 그 연구대상으로 하는지에 대해서는 아직까지 본격적으로 논의되지 아니한 채로 그저 학자들의 개인적인 관심분야에 한정되어 개별 주제나 쟁점들에 대해서 산발적으로 연구가 이루어져왔었다. 이에 필자는 2011년 12월 한국문화 예술법학회의 발족에 맞추어 본고를 작성하면서, 아직까지 우리 법학계에서는 생소한 이른바 "문화예술법"이란 분야의 연구대상, 연구현황 및 앞으로의 연구방향 등에 대해서 서론적인 담론을 다루고자 하였다. 이를 위해 본고의 Ⅰ.에서는 우선 문화예술법제의 의미를 정확히 파악하기 위해서 문화 와 예술 의 의미를 알아보았다. 이후 본고의 Ⅱ,에서는 문화와 예술과 관련되어 어떤 법률들이 제정·시행되고 있는지에 대한 현황을 파악하기 위하여 문화체육관광부가 소관부처로 있는 법률들에 대해 개관하였다. 다음으로 본고의 Ⅲ.에서는 문화예술법제의 연구현황에 대해 우리나라 및 외국의 상황을 살펴보았고, 본고의 Ⅳ.에서는 문화예술법제에 대해 다루어질 수 있는 연구방향에 대해서 탐구하였다. 마지막으로 본고의 Ⅴ.에서는 향후 문화예술법제를 중점적으로 다룰 문화예술법학회의 과제와 역할 및 전망 등을 논급하면서 결론에 갈음하였다.Cultural Law, Art Law or Cultral Art Law is recently often referred in academic field. But it hasn't been discussed that what topics those laws specifically deal with. They still remain not being studied in earnest just limited to personal interest of scholars. The studies concerning this subject has been conducted respectively depending on sporadic issues. Therefore, I wrote this paper in compliance with launching of Korean Association of Cultural and Art Law in December 2011. In this paper I tried to deal with introductory discourse on the objects of study, current status of study and further direction of study. For this purpose, I made a reference to the meaning of "Culture" and "Art" in order to grasp an exact sense of cultural art law in this paper I. I gave a conspectus of various Acts, which the "Ministry of Culture, Sports and Tourism" is in charge of, in order to follow the situation what kind of Acts was enacted and enforced regarding culture and art in this paper Ⅱ. I researched current status of studies on cultural art law in domestic and foreign countries in this paper Ⅲ. I covered further direction of study on cultural art law in this paper Ⅳ. Finally as a conclusion I put emphasis on assignment, role and perspective of Korean Association of Cultural and Art Law which will explore mainly cultural art law.
