디자인보호법 개정안이 저작권법에 미치는 영향과 그 대책

Abstract

2010?2011년 디자인보호법의 각 개정안은 동 법률의 보호대상이 되는 물품을 로카르노 협정의 국제디자인분류(약칭, 로카르노 분류)에 따른 물품으로 확대하도록 제안하고 있다. 로카르노 분류의 도입에 따라 그래픽 심벌과 같은 디자인을 출원할 수 있게 되었고, 이는 디자인의 잠재적 이용에까지 그 보호범위를 확대하게 될 것이다. 로카르노 분류에 따른 그래픽 심벌과 같은 이차원 디자인은 이른바 ‘물품성 요건의 완화’를 보여주는 것이다. 이 논문에서는 ‘물품성 요건의 완화’라고 표현되기도 하는 이러한 개정안의내용이 저작권법상의 응용미술저작물에 미치는 영향을 검토하고, 이를 위하여 로카르노 협정 및 유럽연||||합의 디자인 보호 법제 등에 관해서도 조사하고 분석하였다. 마지막으로 이러한 분석에 근거하여 디자인권과 저작권이 저촉하는 경우 그 대책으로서 입법안을 제시하였다.A proposed amendment to the Design Protection Act in 2010-2011 is supposed to enlarge the scope of articles protected as objects of designs according to the Locarno Classification, an international classification for industrial designs. The introduction of the Locarno Classification will be able to allow applicants to file designs such as graphic||||symbol designs for applications. It will also expand the scope of protection to the potential use of the design. Under the Locarno Classification, two-dimensional designs such as graphic symbol designs represent so-called the relaxation of requirement for item to be an article. This paper aims to study the meaning of the proposed amendment and the effect of such amendment on the works of applied art in the Copyright Act. For this purpose,||||this paper researches EU Design Law and Locarno Agreement in order to analyze them. Finally, this paper proposes the legislative bills as countermeasures in case of conflict-relations between design right and copyright.
