Abstract
국회는 지난 5월 29일 상임위원회가 소관 중앙행정기관의 장이 제출한 대통령령ㆍ총리령ㆍ부령 등 행정입법이 법률의 취지 또는 내용에 합치되지 아니한다고 판단되는 경우 소관 중앙행정기관의 장에게 수정ㆍ변경을 요구(청)할 수 있으며, 이 경우 중앙행정기관의 장은 수정ㆍ변경 요구(청) 받은 사항을 처리하고 그 결과를 소관상임위원회에 보고하여야 한다고 하는 내용의 국회법개정안 제98조의2 제3항을 의결하였으나 대통령이 이에 대하여 위헌을 주장하면서 거부권을 행사하였고, 국회는 이에 대하여 재의에 부쳤으나 여당의원의 표결불참으로 사실상 폐기된 것이나 다름 없게 되었다. 이 사건으로 국회의 시행령수정요구권이 과연 위헌인지 여부가 논란이 된 바 필자의 입장을 밝혀 보기로 한다. 첫째, 헌법 제40조에 따라 입법권은 국회에 속하며, 헌법 제75조와 제95조에 따른 소위 행정입법권은 본래적 입법권이 아니라 파생된 입법권에 지나지 않는다. 둘째, 대통령은 국회가 구체적으로 범위를 정하여 준 범위 내에서 그리고 법률을 집행하기 위해서 시행령을 제정할 수 있다. 결국 행정입법권은 국회가 위임해 준 범위 내에서 이루어질 수 밖에 없다. 셋째, 만일 행정부가 국회의 위임범위를 넘어서 시행령을 제정하는 경우에 이에 대한 통제는 한편으로는 사법부에 의한 명령에 대한 위헌ㆍ위법심사제도와 헌법재판소에 의한 헌법소원심판을 통한 방법이 있으며, 다른 한편으로는 국회 스스로에 의한 통제제도가 존재한다. 넷째, 시행령이 국회가 위임해 준 위임의 범위와 한계를 일탈하지 않도록 국회 스스로 통제할 수 있는 권한은 행정부에 대한 국회의 통제권한으로부터 나올 수 있으며, 또한 헌법 제75조의 위임입법의 한계 규정 자체로부터도 정당화될 수 있다. 다섯째, 행정부가 위임입법의 한계를 벗어나서 국민의 기본권을 침해하는 경우 사법부에 의한 구제는 일종의 구체적 규범통제인 데 반하여, 국회 자체에 의한 위임입법통제는 일종의 추상적 통제제도라고 할 수 있으며, 사법부의 통제와는 별도로 이루어지는 것이므로 사법부에 의한 행정입법의 통제권한을 침해하는 것이 아니다. 그러므로 이를 근거로 하는 위헌론은 근거가 없다. 여섯째, 행정부에 위임을 해 준 국회가 위임을 거두어 들일 수도 있으며, 위임범위를 일탈할 경우에는 그에 대하여 국회 차원에서 통제할 수 있고, 또한 그러한 권한을 상임위원회에 부여할 수도 있다. 독일의 경우에는 법규명령을 제정함에 있어서 의회가 동의, 수정, 거부, 폐지요구 등 다양한 방법으로 행정입법에 관여할 수 있는 권한을 두고 있는 바, 이러한 통제제도에 대하여 독일 연방헌법재판소는 합헌판단을 하고 있으며, 학계도 대부분 그 합헌성을 인정하고 있다. 일곱째, 시행령에 대한 국회의 통제제도는 국민기본권의 보호상 헌법 제75조에 따라서 필수적으로 요청되는 바라고 할 수 있으므로 앞으로 독일식 관여유보제도를 다양하게 도입할 필요가 있다. On May 29, 2015, the National Assembly passed a vote of the revised National Assembly Act bill's Article 98-2(3), according to which, the Standing Committees shall regularly open the committees or sub-committees, and have them examine the Presidential Decrees, the Ordinances of the Prime Minister, the Ordinances of the Ministries which have been submitted by the competent central administrative agencies with respect to whether they are in contravention to the Acts, and where deemed that the relevant Presidential Decrees, etc. are not in accordance with the purport and content of the Acts, they may treat a request the heads of the competent central administrative agencies to amend and change the Ordinances, and also in this case, the head of the central administrative agency shall handle the requested matters and report the results to the Standing Committees. However, the President Park, Geun-Hye vetoed the revised National Assembly Act bill, insisting that the bill was unconstitutional. So that the National Assembly reconsidered the bill on the table, but it was likely to abolish the bill, due to the nonparticipation of the ruling party in the vote. With this case, legal experts are divided over whether the bill is unconstitutional or not, so that I would make my opinion. Firstly, according to the article 40 of Constitution, the legislative power shall be vested in the National Assembly. Moreover, so called the administrative rule making power, in the article 75 and 95 of Constitution, is not original, but subordinate to the legislative power. Secondly, the president may issue the presidential ordinances within the concrete fixed scope of delegation and for the function of the law execution. Therefore, the administrative rule making power must be exercised concerning matters delegated to it by the National Assembly Act.
