국가에 의한 ‘예술 반달리즘’과 예술가의 인격권 침해- 대법원 2015. 8. 27. 선고 2012다204587 판결의 평석을 중심으로 -

Abstract

저작자의 인격은 그의 저작물과 밀접하게 연결되어 있기 때문에 저작자의 인격을 손상시키는 저작물의 변경이나 절제 또는 훼손행위 등을 방지할 수 있도록 하는 권리를 저작자에게 부여하고 있는데, 이를 동일성유지권이라 부른다. 도라산역 벽화 폐기 사건과 관련하여 대법원 판결은 국가배상법에 따라 피고의 위자료 책임을 인정한 원심은 정당하다고 원심판결을 확정하였다. 도라산역 사건은 미술저작물이 화체된 유체물의 훼손 내지 폐기행위가 저작권법상 저작인격권 침해에 해당하는지 여부의 쟁점을 둘러싼 전형적인 사건이다. 미술저작물은 저작자인 화가 이외에 개인이나 사기업 또는 국가나 지방자치단체 등에게 매각되는 경우가 대부분이다. 그러한 경우 미술저작물과 그것이 화체된 유체물과 관련하여 저작인격권과 소유권이 경합하는 잠재적 충돌 상황이 발생한다. 소유권은 유체물에 대해 존재하는 것이지만 저작인격권인 동일성유지권도 존재하기 때문이다. 그러한 점에서 미술저작물의 저작자가 더 이상 유체물의 소유자가 아닐 때, 미술저작물이 화체된 유체물이 파괴된 경우 동일성유지권과 관련하여 문제가 제기된다. 즉 미술저작물이 화체된 유체물의 소유권이 양도되어 미술저작물에 대한 저작인격권의 귀속주체(저작자)와 유체물에 대한 소유권의 귀속주체(소유자)가 분리되었을 때, 유체물 위에 화체된 저작물의 동일성을 유지하는 것보다 소유권이 우선한다고 볼 수 있는지에 관한 매우 어려운 문제가 발생한다. 이러한 쟁점과 관련하여 대법원 판결은 일정한 요건 아래에서 피고(국가)에 의한 원고의 미술작품의 철거와 폐기는 예술가인 원고의 명예감정 및 사회적 신용과 명성을 침해한 것이므로 불법행위에 해당한다고 판시하였다. 동일성유지권이 아니라 예술가의 일반적 인격권, 특히 명예의 보호라는 법리를 통해서 예술작품의 보호를 도모하였다는 점에서 대상판결의 법리적 의의는 크다. Since author’s personality is intimately bound up with his/her work, it is in the author’s interest that he/she should be able to prevent any distortion, mutilation or derogatory action in relation to it that would be prejudicial to author’s personality. It is called right to the integrity of the work (hereinafter “the integrity right” or “the moral right of integrity”). In relation to the destruction of the mural painting installed at Dorasan station (hereinafter “Dorasan case”), the Supreme Court of Korea affirmed the decision of Seoul High Court, which had ruled that the destruction of the mural painting was found to infringe artist’s personality right that constitute as tort under the State Tort Liability Act, even though the mural was in State’s own possession. Dorasan case is a typical problem on conflicts between author’s moral right of integrity and ownership of works of art. Works of art are often sold to individuals, private companies or state and local authorities. Therefore, there is a potential conflict between two competing rights, which arise in relation to the tangible object and the intellectual creation embedded in it. A right of property exists in relation to the tangible object, but ought to coexist with the author’s integrity right. The integrity right is relevant in relation to the destruction of a work of art, when the author is no longer the owner of the tangible object. The question was much debated in Seoul High Court’s Dorasan case whether the property right of the owner of the work (i.e., the mural painting) should or should not prevail over the breach of the integrity of the work which might be arguably committed when the work had been destroyed. It ruled that destruction of mural painting infringed upon artist’s personality right, not upon artist’s moral right of integrity. Supreme Court decision to the lower court’s judgment was to be more specific about artist’s personality right by clarifying the content of personality right as social honor, emotional distress. The main point of this decision is that if a tangible object of a work has been destructed under the certain circumstances, the author of the work of art might be protected by artist’s personality right, not by the author’s moral right of integrity.
