장애인 인권 보호를 위한 입법적 과제

Abstract

2008년 UN 장애인권리협약 비준을 전후하여 우리나라는 동 협약의 국내이행을 위해 2007년의 “장애인차별금지 및 권리구제 등에 관한 법률”에서부터 2014년의 “발달장애인 권리보장 및 지원에 관한 법률” 등에 이르기까지 다수의 법률을 입법하였다. 그러나 장애인 인권보호를 위한 기본제도의 정비라는 점에서 부족한 영역이 여전히 많이 남아 있다. 현재에도 장애인단체 등에서는 장애인 인권보호를 위한 긴급한 현안으로 ‘장애등급제의 폐지’나 ‘장애인권리옹호 및 지원 제도(소위 P&A 제도)’의 도입 등을 주장하고 있다. 그런데 장애인 인권보호를 위한 기본 제도로서 주장되는 여러 제안들은 무계획적?산발적인 것처럼 보이기도 한다. 의사결정지원제도로 활용될 수 있는 성년후견제도에 대해서는 유력한 장애인단체에서 그 폐지를 주장하기도 하고, 발달장애, 정신장애, 치매 등의 각 영역마다 유사한 제도의 도입을 각기 주장하기도 한다. 이 글은 장애인 인권보호를 위해 산발적으로 제시되는 입법적 제안에 대한 반성으로 장애인 인권보호를 위한 기본제도가 어떤 것이어야 할지에 대해 하나의 방향성을 제시하고자 하였다. 이를 위해서는 먼저, 장애에 대한 올바른 관점을 확보하고(올바른 paradigm의 정비), 그 관점 하에 개입할 영역을 정확히 파악하는 것이 필요하다고 보았다. 이 글에서는 장애인 인권보호를 위해서는 가장 선결할 것이 장애정책의 새로운 패러다임으로 의료적 장애개념을 버리고, 사회적 장애개념을 채택해야 한다는 것, 모든 장애인에게 적용될 인권 및 권익옹호기관의 정비, 이 기관의 활동을 뒷받침해 줄 민사소송법의 개정, 경제적 지원제도로서의 특별수요신탁제도의 도입, 지역사회에서의 통합적 일상생활 영위가 가능하도록 하는 의사결정지원제도 등이 기본제도로 정비되어야 한다고 보았다. Regarding legislative tasks for the protection of human rights of persons with disabilities, it is important to begin with general perspectives on their human rights. In this regard, the UN Convention on the Rights of Persons with Disabilities shows the broadest criteria thereon; its essential core is that any person with disabilities shall be respected as a human being and that all the discriminative laws, systems and customs including positive, and negative, discriminative measures shall be eliminated, whereby all the barriers preventing persons with disabilities living together in the communities can be demolished. To integrate disabled persons into the communities, it is indispensible to provide them with reasonable adjustment or reasonable accommodation so as to enable them to supplement their deficiencies arising from their disabilities. This paper deals with what legislations, especially in which area related to disability policies legislations, are to be made. For proper legislations to be achieved, it is important to set up correct paradigm for disability policies and to draw proper maps to reach the goals set by proper paradigm. In ths regard, this paper suggests that paradigm shift is required from the medical approach, to the social approach, to the concept of disabilities and that protection and advocacy system for the individual rights of persons with disabilities in legal life and assistances both to financial life and everyday life should go hand in hand.
