자연어 처리 모델을 이용한 특허 청구항 작성 및 구체화 방법

Abstract

This research is about a method of drafting and developing patent claims using natural AI language processing models. This research is about a method and system that can apply the creative ability, automation ability, and mass processing ability, and learning ability for formalities of the natural language processing model, which has shown a dramatic performance improvement since the recent release of Transformer, to the field of patent claim drafting. More specifically, this research includes a total of four phases. The first phase is claim generation. The first phase is to generate the output in the form of patent claim from the input of the seed idea of the invention using a natural language generative model. The second phase is claim development. The second phase is, using a natural language generative model, to develop the claim generated through the phase 1 further in multiple directions. The third phase is claim clustering. The third phase is, using a natural language understanding model, to track and analyze the direction of the developments generated through the phase 2. The fourth phase is to further claim development. The fourth phase is, using the information obtained from the phase 3, to develop the claim further and induce the development in a selected direction. The majority of experiments has been performed in field of electronic cigarettes whose elements are relatively easy to understand. This research demonstrated a new application of natural language processing models into the field of patent claim drafting and development. It was demonstrated that a seed idea can be developed using a natural language generative model. It was also demonstrated that the direction of the development can be tracked using a natural language understanding model and the development can be induced to further into a selected direction using. As a future research proposal, analyzing the inventiveness of the results generated through the method according to this study is necessary. In addition, it is necessary to pursue in-depth research on outliers generated in the claim specification stage. In addition, research on prompt engineering in the field of drafting and development of patent claims is necessary.

|본 연구는 자연어 처리 모델을 이용한 특허 청구항 작성 방법 및 시스템에 관한 것이다. 본 연구는 최근 Transformer 공개 이후 비약적인 성능 향상을 보인 자연어 처리 모델의 창의적 능력, 자동화 및 대량 처리 능력 및 형식적 사항에 대한 학습 능력을 특허 청구항 작성 분야에 적용할 수 있는 방법 및 시스템에 관한 것이다. 보다 구체적으로는, 본 연구에 따른 청구항 작성 및 구체화 방법은 총 4단계를 포함하며, 제1 단계는 청구항 생성 단계로서 자연어 생성 모델을 이용하여 발명의 시드 아이디어로부터 청구항 형태의 결과물을 생성하는 단계이고, 제2 단계는 청구항 구체화 단계로서 제1 단계를 통해 생성된 청구항 형태의 결과물을 자연어 생성 모델을 이용하여 다수의 방향으로 발전된 청구항들을 생성하는 단계이며, 제3 단계는 청구항 군집화 단계로서 제2 단계를 통해 발전된 구체화 내용을 자연어 이해 모델을 이용하여 추적 및 시각화하는 단계이다. 제4 단계는 청구항 구체화 심화 단계로서 제3 단계를 통해 파악한 청구항 구체화 내용에 관한 정보를 이용하여 청구항들을 더욱 구체화시키고, 특정한 방향으로 청구항들이 구체화되도록 유도하는 단계이다. 본 연구에서 대부분의 실험들은 그 구성 요소들에 대한 직관적인 이해가 용이한 전자 담배 분야에서 진행되었다. 본 연구는 자연어 처리 모델을 특허 청구항 작성 분야에 적용하여 자연어 생성 모델을 이용하여 시드 아이디어를 구체화시킬 수 있고, 자연어 이해 모델을 이용하여 그 구체화 방향을 추적할 수 있음을 보였고, 또한 특정 방향으로 구체화되도록 유도할 수 있음을 보였다. 향후 연구 제안으로, 본 연구에 따른 방법을 통해 생성된 결과물의 진보성 지표에 대한 분석이 필요하다. 또한 청구항 구체화 단계에서 생성된 이상치(Outlier)들을 추적하여 심화 연구해 볼 필요가 있다. 또한 특허 청구항 작성 및 구체화 분야에서 prompt engineering에 대한 연구가 필요하다.
