스포츠 금지약물 근절 및 선수 인권 보호의 정책 형성과정 비교 연구: 다중흐름모형을 중심으로

Abstract

The purpose of this study is to analyze the process of amendments to the National Sports Promotion Act, in which policies to protect integrity of sports, such as the tackling doping and the prevention of sexual violence in sports. The legislative process is analyzed and compared based on Kingdon's Multiple Stream Framework model. Furthermore, by analyzing the background of the two sports policies and the process of agenda formation, and combining them with the government sports policy that has expressed 'sports for all' in the future, we are trying to find practical policy suggestions necessary to establish fairness and ethics in sports. In this context, this study attempts a comprehensive review and comparative analysis of policies to protect human rights of athletes, such as tackling doping and prevention of sexual violence in sports, using the Kingdon’s Multiple Stream Framework model. The specific research questions are 1) whether the formation process of the two policies for sports fairness fits Kingdon’s MSF model 2) What is the most important factor in the process of realizing the two policies as policy outputs? 3) What are the commonalities and differences in the process of agenda formation of the two policies? As a result of analyzing the multi-flow model as the framework of the study, the policy on the tackling in sports had the flow elements of problems, alternatives, and politics. In particular, it was found that policy issues and policy alternatives existed before, and that the international trend on sports anti-doping policy acted as a political flow and opened the window of policy, which was consistent with the framework of analysis. in additional, it was confirmed that it was enacted as a means of anti-doping activities at the national level to achieve the government's goal of hosting the Olympics. Policies on the protection of athletes' human rights have been promoting policy issues that have not been resolved for a long time and policy alternatives to them. Politically, there has been a continuous flow. However, it was confirmed that there was no case in which the three independent streams were accidentally combined and the policy window was opened for a considerable period of time. In the end, a policy window was opened through a decisive event, and at the same time, a policy was produced through the National Assembly legislation. Based on the results of analyzing each of the above policies, both the tackling and the protection of athletes' human rights policy had three independent streams of Kingdon's multi-flow model in the legislative process. In addition, it was possible to confirm a series of processes in which the policy window was opened by the coincidence of the three streams and the policy was produced through the efforts of policy leaders. The main common factor attributable to policy decisions is the 'political flow'. However, there was a difference in that the policy to eradicate prohibited substances was drafted by the government in consideration of international trends, and the protection of athletes' human rights was drafted by the National Assembly to solve domestic problems. As suggested by this study, by integrating and expanding the two organizations (Korea Anti-Doping Agency, Sports Ethics Center) dealing with sports fairness and ethics in the future, strengthening functions such as recognizing the right of autonomy in sports organizations and strengthening investigation capabilities, and targeting all ages in the sports A 'prevention' based education system was prepared, and strict management plans & mandatory education procedures were proposed for athlete managers who train, treat, and support athletes other than sports instructors.| 본 연구의 목적은 스포츠 공정성 확립을 위해 형성된 금지약물 근절과 성폭력 예방 등 선수 인권 보호 정책이 입안된 국민체육진흥법 일부개정안의 입법과정을 Kingdon의 다중흐름모형을 중심으로 분석하고 이를 비교해 보고자 함에 있다. 나아가 두 체육 정책이 생겨난 배경과 의제 형성 과정을 분석하고 앞으로 ‘모두를 위한 스포츠’를 표명한 정부 체육정책과 결합하여 스포츠의 공정성ㆍ윤리성 확립에 필요한 실천적 정책 제언을 찾고자 한다. 이러한 맥락에서 본 연구는 Kingdon 다중흐름모형을 활용하여 스포츠 금지약물 근절과 스포츠 성폭력 예방 등 선수 인권 보호 정책에 관한 종합적 검토와 비교 분석을 시도하며 구체적인 연구문제는 1) 스포츠 공정성을 위한 두 정책의 형성과정이 Kingdon의 다중흐름모형 분석틀에 부합하는가? 2) 두 정책이 정책산출물로 실현되는 과정에서 가장 중요하게 작용한 요인은 무엇인가? 3) 두 정책의 의제 형성과정에서 나타난 공통점과 차이점은 무엇인가? 로 설정하여 향후 스포츠 공정성 관련 제도개선에 기여할 수 있는 가능성을 분석하고 정책의 시사점을 도출하는 것이다. 따라서 본 연구에서는 스포츠 금지약물 근절 정책에 있어서 정책 문제의 흐름, 정책대안의 흐름, 정치의 흐름이라는 세 가지 주요 흐름의 내용과 독립적인 흐름 간의 상호작용과 불확실성에 근거한 우연한 사건으로 인한 정책의 창 개방 순간과 정책선도가의 중추적 역할을 통한 정책의 산출을 중심으로 고찰하였다. 마찬가지로 Kingdon의 다중흐름모형 분석틀에 따라 스포츠 성폭력 예방 등 선수 인권 보호 정책과 관련하여 분석한 뒤, 앞서 제시한 스포츠 금지약물 근절 정책과 비교ㆍ분석하여 시사점을 도출하였다. 다중흐름모형을 연구의 분석틀로 분석한 결과, 스포츠 금지약물 근절에 관한 정책은 문제ㆍ대안ㆍ정치 흐름의 각 특징적 요소를 지니고 있었고 특히 정책문제와 정책대안이 이전부터 존재하였으며 스포츠 도핑방지정책에 관한 국제적인 동향이 정치의 흐름으로 작용해 정책의 창이 개방된 점이 분석틀에 부합하는 것을 알 수 있었다. 특히 올림픽 유치를 위한 국가적 목표를 달성하기 위해 정부가 정책선도가로서 금지약물 근절 관련 행정입법을 추진한 것을 확인할 수 있었다. 선수 인권 보호에 관한 정책 관련하여 체육계는 오랜 기간 해결되지 않은 정책문제에 대한 정책대안을 추진하고 있었으며 정치적으로도 지속적으로 개선의 움직임이 존재했으나 독립적인 세 가지 흐름이 우연히 결합하여 정책의 창이 개방된 사례가 상당한 기간 동안 없었음을 확인할 수 있었다. 결국 결정적인 사건을 통해 정책의 창이 열림과 동시에 국회입법을 통해 정책이 산출되었다. 다만 정부도 정책대안을 마련하였으나 선언적 정책이었을 뿐 정책 산출로 연장되지 않았다. 각각의 정책을 Kingdon 다중흐름모형으로 분석한 결과를 토대로 본 연구에서 제시한 연구문제에 대해 비교 분석적 관점으로 분석한 결과는 다음과 같다. 첫째, 금지약물 근절 정책과 선수 인권 보호 정책은 입법 과정에 있어서 Kingdon의 다중흐름모형의 세 가지 독립적 흐름과 우연히 세 흐름이 결합하여 정책의 창이 열리고 정책선도가의 이슈 주창을 통해 정책이 산출되는 일련의 과정을 확인하였다. 둘째, 정책산출물로 실현되는 과정에서 가장 중요하게 작용한 요인은 ‘정치의 흐름’이라고 할 수 있다. 셋째, 의제 형성과정에서 나타난 공통점과 차이점 관련하여, 공통점은 문제의 흐름이 나타난 배경이 ‘국위선양’으로 인한 과도한 성적 지상주의, 폐쇄적이며 주종관계의 훈련 등이라는 것과 차이점은 금지약물 근절 정책에는 국제적 흐름을 반영한 정부 주도의 행정 입안이, 선수 인권 보호는 국내의 문제를 해결하기 위한 국회 입안이었다는 것을 확인할 수 있었다. 아울러 두 정책의 정책산출물로 국민체육진흥법이 개정되었음에도 불구하고 계속적으로 금지약물 사용과 선수 성폭력 사례가 발생하고 있어 체육 관계기관 간의 ‘자발적인 협력으로서의 거버넌스’에 대해 면밀한 고찰과 후속 연구가 수반되어야 할 것이다.
