1990년대 이후 중대 재난·재해에 따른 건축법 및 관련법의 변화 양상과 사회적 파급효과

Abstract

우리나라의 건축법은 1962년에 제정된 이후 빠른 산업화 및 도시의 발전과 함께 발전해왔으며, 중대 재난, 재해의 발생에 따라 우리나라 건축법 및 관련법 또한 많은 변화를 거듭해 왔다. 건축법은 시민의 안전에 직결되는 법이므로 그 중요성이 매우 크다. 하지만 건축법의 중요도에 비해 시민과 산업계의 이해도가 낮고, 법의 내용이 복잡하다는 점에서 다양한 관점의 연구가 수행되지 않았다. 따라서 법령의 집행 측면에서 본 건축법, 건축법에 맞춰 계획하는 설계자의 입장에서 본 건축법, 목적 유도 및 행정절차 등 행정 입장에서 본 건축법뿐만 아니라 최종적 수혜자인 시민 입장에서 본 건축법까지 다양한 논의가 필요하다. 이에 본 연구에서는 우리나라 건축법의 정의와 특징, 건축법의 역사 및 구조 그리고 건축 관련법의 구조에 대해 살펴보았으며, 주요 국가들의 건축법과의 비교를 통해 우리나라 건축법의 개선점을 도출하였다. 또한 건축법 및 건축 관련법에 유지관리 기준을 추가하여 제안하는 등 실무적 입장에서의 대안을 제시하였으며, 건축법과 1990년대 이후 중대 재난·재해를 시계열 분석을 통해 연계성을 분석하였다. 결과적으로 법에서부터 재난·재해까지 연결함으로써 건축법과 건축 관련법이 결국에는 국민의 안전까지 이어짐을 밝혔다. 우리나라 건축법은 아직 다른 주요 국가들에 비해 부족한 부분이 있으므로 국외 건축법과의 비교 분석을 통해 건축물 등급에 대한 시기별 변천과 재난·재해와의 연계성을 보다 심화시켜 추가하고 설계적 관점 및 법제적 관점뿐만 아니라 재료 성능을 통한 건축물의 안전성까지 다룬다면 보다 완벽한 법체계가 완성될 수 있을 것으로 판단된다. 본 연구가 시민뿐만 아니라 각 건축업계 관계자들이 건축법을 이해하고 사회와 시민의 안전을 위해 그 중요성을 인식하는 데 도움이 되길 기대한다.|Since the Korean building law was enacted in 1962, it has developed along with rapid industrialization and urban development. And with the occurrence of major disasters and disasters, Korea's building code have undergone many changes. These building laws are very important because they are directly related to the safety of citizens. However, compared to the importance of the building law, the understanding of citizens and industry is low, and the contents of the law are complex, so there are not many studies conducted from various perspectives. Therefore, various perspectives are needed, from the perspective of law enforcement, the perspective of the architect who plans according to the law, and the discussion of the building law from the perspective of the final beneficiary, the citizen, as well as the building law from the perspective of the administrative manager. In this study, the definition and characteristics of the Korean building law, the history and structure of the building law, and the structure of the building-related law were examined, and improvements in the Korean building law were derived through comparison with the building laws of major countries. In addition, it was proposed to add maintenance standards to the building code, and the connection between the building law and major disasters and disasters was analyzed through time series analysis. As a result, it was revealed that by linking the law and disasters and disasters, the building law and building related laws ultimately lead to the safety of the people. Korea's building code still has some shortcomings compared to other major countries. Therefore, through comparative analysis with foreign building laws, it would be better if the linkage between changes in building grades by time and disasters and disasters was further deepened and added, and the safety of buildings through material performance as well as design and legislative aspects were dealt with. It is judged that a perfect legal system can be completed. It is hoped that this study will help not only citizens but also stakeholders in the construction industry to understand the building law and to recognize its importance for the safety of society and citizens.
