dc.description.abstract2014년 6월 27일 적도 기니(Equatorial Guinea)의 말라보(Malabo)에서 개최된 AU의 ‘국가원수 및 정부수반 회의’, 즉 AU총회는 “아프리카 사법 및 인권재판소 규정에 관한 의정서의 개정에 관한 의정서”라는 소위 말라보의정서를 채택하였다. 말라보의정서는 아프리카 문제에 대한 아프리카 식의 해결방안 제시의 일환으로 아프리카 지역에 고유한 형사재판소로서 통칭 ‘아프리카형사재판소’를 설립하고자 하고 있다. 이 의정서는 15개국의 비준서 기탁일로부터 30일 후에 발효되도록 되어 있지만, 아직까지 어느 국가도 비준하지 않고 있다. 말라보의정서의 주된 목적은 아프리카형사재판소를 설립하는 것으로, 그 방식은 이직 설립되고 있지 않은 ‘아프리카사법 및 인권 재판소’(ACJHR)를 개편하여 이 재판소 내에 3가지 부류의 관할권을 가지는 재판부를 설치하고 그 중 하나를 새롭고도 전문적인 형사재판부, 즉 ‘국제형사법 부문’(International Criminal Law Section)이라는 명칭을 가지는 재판부로서, 소위 통칭 ‘아프리카형사재판소’로서 신설하는 것이다. 다시 말하면 말라보의정서는 ACJHR 내에 세 부류의 재판부를 두어, 아직까지 설립되지 않은 사법재판소를 대체하는 ‘일반사항 재판부’(the General Affairs Section)와 인권보호를 위한 관할권을 가지는 ‘인권 및 인민권 재판부’(the Human and Peoples’ Rights Section), 이 외에, 새로이 광범위한 부류의 ‘국제범죄에 대한 관할권’을 가지는 ‘국제형사법재판부’를 둘 예정이다. 이 세 번째 재판부는 특히 집단살해죄, 인도에 반한 죄, 전쟁범죄 및 침략범죄와 같은 핵심적인 ICC 관할대상범죄는 물론, 그 외에 해적, 테러범죄, 부패, 자금세탁, 마약거래 등 아프리카 지역에서 자주 발생하는 10개 범주의 범죄에까지 관할권을 확대하고 있다. 말라보의정서는 아프리카형사재판소 설립과 관련하여 국제법상 지금까지 전례가 없었던 새로운 제도적 측면을 제시하고 있다. 무엇보다도 이 재판소는 국제적 차원에서 자행된 인권위반에 대해 국가차원의 국제책임을 묻는 제도와 함께 개인차원에서의 형사책임을 통합적으로 다룰 수 있다. 다만, 말라보의정서는 현직 국가원수 및 정부수반과 고위직 국가관리들에 대해 아프리카형사재판소에서의 재판권 면제를 인정함으로써 특히 이러한 면제를 부인하고 있는 ICC규정과의 마찰을 야기하고 있다. 국제형사재판소(ICC)설립 이후 그동안 아프리카 국가들은 현행 국제형사법의 적용과 집행에 대하여 많은 불만을 가져 왔다. 아프리카국가들은 아프리카의 국가원수 및 고위관료들을 집중적으로 기소하여 온 ICC의 사법정책을 인종차별적이고 서구의 강제적인 정의 구현, 신식민지주의의 적용이라고 비난하고 있으며, 이러한 사실은 아프리카의 ICC에의 협력체제에 큰 균열을 야기하고 있다. 또한 보편적 관할권 등 역외관할권을 행사하려는 유럽국가들에 대한 불만은 AU와 EU 간의 갈등을 유발시키는 원인이 되기도 하였다. 이에 따라 아프리카 국가들은 국제형사사법 분야에서 자기결정권을 가질 필요성을 인식하게 되었고 그 결과로 나타난 것이 아프리카형사재판소를 설립하기 위한 말라보의정서의 채택이다. 이러한 변화는 아프리카 국가들이 국제형사법의 적용대상인 객체가 아니라 국제형사법의 적용과 발전을 주도하는 주체로 변모하려는 시도라고 생각된다. 말라보의정서가 국가원수 면제에 관한 조항을 포함한 것에 대해서는, 국제형사법의 발전경향에 역행하고 전통적인 국제법원칙으로 회귀하는 결과를 야기하고 있다는 비판도 제기되고 있지만, 그 근거가 되고 있는 법리는 현행 관습국제법에 위배된다고 볼 수는 없다. 현행 관습국제법은 국가원수 등 국가관리들이 국제형사법정에서 면제되는 것을 요구하고 있지도 않고 금지하고 있지도 않기 때문이다. 다만, 말라보 의정서 내에 제46조A bis에 재판권면제조항을 포함한 것은 국제형사법상 신의칙에 맞지 않는 행위이며 ‘중대한 국제범죄에 대한 불처벌(impunity)의 종식’이라는 AU의 정신 및 문화와 국제법의 조류에도 부합하지 않는 측면이 있다. 현행 국제법상 주권보다 인권을 우선시하는 경향을 볼 때, 이러한 움직임은 법적 근거가 박약한 것으로서 많은 논란을 야기할 것으로 보인다. 신제도의 설립이 결정되긴 하였지만 실제 가동시기가 불명확한 점에 유의해야 한다. 2020년 6월 시점에서 서명국은 15개국이지만 비준을 한 국가는 아직 없으므로 현 시점에서는 여전히 미발효 상태이다. 또한 말라보의정서의 조문상 문법이나 문구를 고쳐야 하는 부분도 존재한다. 또한 ICC와 각종 임시국제재판소 설립시 막대한 자금과 설비, 폭넓은 인재의 지혜와 노력의 결집 등이 필요하다는 것을 고려한다면, 말라보 의정서에서 명문화하고 있는 사법제도가 현실적으로 운용되기 위해 필요한 예산과 인력 확보가 가능한가라는 점에 대해서도 의문이 존재한다. Many African States have been the ardent supporters for the operation of the International Criminal Court(ICC), and The African States are the largest group in the membership of the ICC. But over the years some African States have criticized the attitude of the Court for being too focused on their continent. This phenomenon was mainly derived from the fact that the ICC has investigated and prosecuted the incumbent heads of African State or government of Sudan, Libya and Kenya. This criticism urged the Assembly of the African Union to adopt “the Protocol on Amendments to the Protocol on the Statute of the African Court of Justice and Human Rights”(the Malabo Protocol) in June 2014. This new Court will, once its Statute enters into force upon achievement of the 15 required ratification, be a highly ambitious court with three separate chambers: (1) the General Affairs Section, (2) the Human and Peoples' Rights Section, and (3) the International Criminal Law Section. The International Criminal Law Section that has the jurisdiction on the 14 international crimes will function as the African Criminal Court. Until now there is, however, no State that ratified the Malabo Protocol. Article 46A bis of the Malabo Protocol provides for the immunity of the sitting heads of State or government or any other senior state officials before the African Criminal Court, which is contradictory to Article 27 of the ICC Statute. This is the most contentious provision of the Malabo Protocol. From a legal point of view, current customary international law is silent about immunities for sitting heads of State or government before international criminal courts or tribunals. There is no legal rule under customary international law denying immunity of the heads of State or requiring the immunity before international criminal courts or tribunals. Therefore, the Article 46A bis seems to be not contradictory to today's customary international law in that the customary international law does not deny immunities of the heads of State or government before international criminal courts. However, the Article 46A bis seems to undermine the fight against immunity. The African Criminal Court extends its jurisdiction to 14 international crimes, while also expressly including immunity of the heads of State or government. This Article will shield the perpetrators of the international crimes from being tried or punished before international courts or tribunals and consequently harm the fight against impunity by permitting the immunity of the heads of State from the reach of international justice.en_US
