국가핵심기반 정비에 대한 민간 참여에 관한 연구 — 네트워크 이론과 민관협력의 관점을 중심으로 —

Abstract

현대 사회에서 발생하는 재난(감염병 등)은 발생 빈도가 늘어나고, 규모도 커지고 있다. 이와 같은 재난에 대비하기 위해서는, 재난관리와 관련된 시설, 즉 국가핵심기반이 매우 중요한 위치를 차지한다. 그러나 한국의 현행 법제에서는, 국가핵심기반의 정비에 민간의 역할이 굉장히 제한적인 것이 문제점으로 지적된다. 이 문제는 결과적으로 해당 시설의 전문가나 주민의 의견이 반영되지 않은 채 적절한 재난 예방의 기능을 수행하지 못하게 만든다. 이와 같은 문제점을 해결하기 위해서는 재난관리를 국가, 사경제주체로서의 시장, 주민과 일반 국민 모두의 책무로 보고, 함께 대처하는 네트워크 이론의 관점에서 볼 필요가 있다. 이때 국가핵심기반 정비에 참여할 수 있는 민간주체로는, ① 민간기업, ② 주민 및 일반인, ③ 공익단체를 고려할 수 있다. 첫째, 민간기업의 참여를 확대하는 방안으로, 민간기업이 국가핵심기반의 운영에 참여할 수 있는 사업 방식의 정비가 필요하다. 이때는 일본의 공공시설 등 운영권 제도를 참고한다. 둘째, 주민과 일반인이 국가핵심기반 건설 때 계획확정에 참가하는 방안으로, 계획수립에 참여하고 의사결정에 영향을 줄 수 있는 법제를 개발한다. 이때에는 독일의 계획 확정 절차를 참고한다. 셋째, 공익단체(시민단체 즉 NGO, 국제구호단체와 같은 비영리단체 즉 NPO)의 감시권과 시정 요구권을 정비하여 관리기관이 국가핵심기반을 문제없이 관리하게 감시하고, 관리가 잘 되지 않는 경우 시정을 요구하는 역할로 참여하는 방안이다. 이때에는 독일의 환경단체소송을 참고한다. 민간주체들과의 협력을 통해 국가핵심기반을 정비하는 방안을 제시함으로써, 적절하게 재난을 관리할 수 있는 것을 기대할 수 있다. Nowadays, we are suffering unprecedented disaster from world-scale disease or other kind of national risk. To cope with this disaster, public facility which related with disaster management, for example, the national infrastructure has very important position. Despite of importance of the national infrastructure in Korea, limited private sector’s participation to complete arrangement of the national infrastructure is problem. This problem can cause disfunction of the national infrastructure, because it doesn’t reflect professional's(on the national infrastructure) or resident’s opinion. To solve this problem, the writer suggests some viewpoint from Network Theory; disaster management needs cooperation between public sector and private sector. Private sector can consider following three actors: ① private corporation, ② residents and the general public, ③ public organizations(NGO, NPO & international organization). The writer suggests following three ways as specified solutions: First, complete arrangement of Private Finance Initiative(PFI), in which private corporation could perform operating work at the national infrastructures, would be necessary. For this complete arrangement of Private Finance Initiative(PFI), we could consider or rely upon the right to operate public facility in Japan. Second, a legal system, in which residents & the general public could participate in the decision making procedure on national infrastructure arrangement plan, would be necessary. For this kind of legal system, Planing Approval Procedure in Germany, could be considered or relied upon by us. Third, the public organizations(NGO, NPO or the International Relief Organization) could participate in filing evironmental class action as the observer on the national infrastructure. And in the case that disaster management agency performs in the wrong way, the public organizations(NGO, NPO or the International Relief Organization) could demand the disaster management agency to correct the wrong management. The above three ways in which cooperation between public sector and various private sectors in complete arrangement of the national infrastructure are suggested to improve the disaster management in Korea.
