문화재단의 법적 고찰 - 지역문화재단을 중심으로 -

Abstract

오늘날 우리 사회에서 제3섹터의 비중은 점점 커지고 있는데, 제3섹터에 있어서 핵심적인 역할을 하는 조직체 중의 하나는 재단법인이다. ‘비영리’사업 중에서 특히 ‘문화’사업을 목적으로 하는 재단법인을 문화재단이라고 부른다. 본고는 재단법인 중에서 문화사업을 목적으로 하는 재단, 즉 문화재단에 관한 법적 특성을 고찰하였다. 문화재단 중에서도 특히 지방자치단체가 출연하여 설립된 지역문화재단을 중심으로 살펴보았다. 본고는 문화재단에 대한 기초적인 이해를 바탕으로(II.), 문화재단의 법적 근거를 고찰하고(III.), 경기문화재단을 중심으로 문화재단의 설립과 운영에 관한 법적 구성체계를 살펴보고(IV). 마지막으로 문화재단의 문제점과 개선방향에 대한 약간의 소견을 정리하였다(V). 본 연구를 통하여 필자는 문화재단의 발전을 위해 다음과 같은 의견을 제시하였다. 첫째, 지역문화재단이 일관되고 지속적인 사업을 영위하기 위해서는 가급적 지방정부로부터 독자적이면서 안정적인 재원을 마련하는 것이 무엇보다 중요하다. 둘째, 현재 지방자치단체마다 계속 늘어나고 있는 지역문화재단의 설립이 과연 바람직한가는 의문이 있으며, 각 지자체마다 문화재단의 설립에 앞서 사업의 실효성 및 예산의 확보방안 등에 대해 충분한 검토를 거친 후에 설립여부를 결정하는 것이 바람직하다. 셋째, 문화재단의 설립을 활성화하기 위해서 민간의 참여를 유도할 필요가 있는데, 공익법인법을 개정하여 문화ㆍ예술사업도 공익사업의 범주에 포함시킴으로써 문화재단에도 공익법인의 세제혜택을 부여함으로써 민간자본이 문화재단으로 유입될 수 있도록 할 필요가 있다. 넷째, 지역문화재단과 다른 조직체와의 관계설정을 분명히 할 필요가 있다. 즉, 지역문화재단과 지역문화예술위원회 및 광역문화재단과 기초문화재단이 어떤 역할을 하여야 하는지에 대해 보다 명확한 정리가 필요하다. Today the weight of the third sector is growing in our society. One of the key organizations in the third sector is the foundation. Among the 'non-profit' projects, the foundation, which is specifically aimed at the 'culture' project, is called the cultural foundation. This paper examines the legal characteristics of cultural foundations. Among the cultural foundations, the focus was mainly on the regional cultural foundations established by local governments. Based on a basic understanding of the foundation (II.), This paper examines the legal basis of the foundation (III.), and the legal framework of the establishment and operation of the foundation (IV). Finally, some findings on the problems and improvement directions of the cultural foundation were summarized (V). In this study, I suggested the following opinions for the development of the cultural foundation. First, it is important to provide independent and stable financial resources from local government as much as possible in order for local cultural foundations to carry out consistent and continuous projects. Second, It is advisable to determine the establishment of each municipality after fully examining the effectiveness of the project and securing the budget before establishing the Cultural Foundation. Third, it is necessary to induce private participation in order to promote the establishment of the Cultural Foundation. The Public Interest Corporation Act should be amended to include cultural and art projects in the category of public interest projects, so that private capital can be introduced into the Cultural Foundation by granting tax benefits to the Cultural Foundation. Fourth, it is necessary to clarify the relationship between the local cultural foundation and other organizations. In other words, it is necessary to clarify what role in terms of the regional cultural foundation regional cultural arts committee, regional local cultural foundation and basic local cultural foundation should play.
