Special Cases Concerning the Punishment, etc. of Sexual Crimes; and the Act on the Protection of Children and Youth against Sex
Offenses. First, the Punishment of Violences, etc. Act was
enacted as a law for punishment by an emergency legislative
body, not by the National Assembly, in response to the
circumstances of the time, and the overall provisions were also
completed as a heavy penalty system by adding components to the
basic crime types for punishment. Second, the Act on the
Aggravated Punishment, etc. of Specific Crimes has provisions
regarding specific crimes such as bribery, loss of National
Treasury, and drug offenses in order to contribute to the
maintenance of sound social order and the development of the
national economy. However, it does not correspond to the legal
system as it stipulates various special crimes under the
provision on the loss of National Treasure. Lastly, the Act on
Special Cases Concerning the Punishment, etc. of Sexual Crimes
and the Act on the Protection of Children and Youth against Sex
Offenses are a mixture of regulations on punishment on sexual
violence punishment and special provisions under the Criminal
Procedure Act, causing confusion in legal application.
To address these issues, it would be appropriate to abolish
the Punishment of Violences, etc. Act altogether. As for the
Act on the Aggravated Punishment, etc. of Specific Crimes,
aggravated punishment on the divulgence of secrets on official
duties, drivers of hit-and-run vehicles, and death and injury
due to dangerous driving should be incorporated into the penal
code, and the rest of the law should be abolished. In case of
the Act on Special Cases Concerning the Punishment, etc. of
Sexual Crimes and the Act on the Protection of Children and
Youth against Sex Offenses, punishment regulations that have
not been part of the Criminal Act should be newly incorporated
(imitative rape by relatives; intimidation, compulsion, etc.
using filming, etc.). Punishment regulations should all belong
to the Criminal Act, as appropriate, and only procedural
regulations such as special regulations in the Criminal
Procedure Act or the registration, disclosure, and notification
of sex offenders' personal information from the Act on Special
Cases Concerning the Punishment, etc. of Sexual Crimes; and the
Act on the Protection of Children and Youth against Sex
Offenses should be left.
As such, despite their temporary and exceptional nature, the
special criminal acts are difficult to abolish once they are
enacted. In particular, as Korea follows the written law
system, anything that exists in a special act has priority in
application than a general act by principle. Therefore, the
most important part would be to prevent indiscreet legislation
of special criminal acts and enact or amend after sufficient
review and discussion. In the future, special criminal acts
should be enacted or amended to stipulate exceptional areas,
not for heavy punishment to accommodate public sentiment.| 현재 우리나라는 기본법인 형법과 형사특별법, 행정형법 등이 존재하고 있다. 그러나 임시법·예외법적인 성격을 가지고 있는 형사특별법이 무분별한 입법으로 인해 기본법인 형법을 사문화·공동화 시키고, 법정형의 무분별과 불균형을 가져오며, 이중처벌의 가능성을 내포하고 있다. 또한 실무적으로는 특별법이 방대하고 잦은 개정으로 인해 해석의 과중함이 문제되며 법정형과 현실의 괴리가 발생하게 된다.
본 논문에서는 폭력행위 등 처벌에 관한 법률, 특정범죄 가중처벌 등에 관한 법률, 성폭력범죄의 처벌 등에 관한 특례법, 아동·청소년의 성보호에 관한 법률 총 네가지의 형사특별법에 대하여 검토하였다. 폭력행위처벌법의 경우 당시의 시대상황에 따라 입법권을 가진 국회가 아닌 비상입법기구에서 처벌을 위한 법률로써 제정되었고, 전체 조항들도 처벌을 목적으로 한 기본 범죄유형에 구성요건을 더해 중형주의식 입법을 완성시켰다. 두 번째로 특정범죄가중법의 경우 건전한 사회질서의 유지와 국민경제의 발전에 기여하기 위하여 뇌물죄, 국고 손실죄, 마약사범 등의 조문을 만들었으나 특정범죄의 가중 처벌을 위하여 국고 손실죄 하위에 각종 특별 범죄를 규정하는 등 법체계도 맞지 않는 법률이 되었다. 성폭력특별법 및 청소년성보호법은 성폭력에 대한 처벌에 대한 규정과 형사소송법 상의 특례규정 등이 혼합되어 법적용에 혼란을 초래하고 있다.
이에 폭력행위처벌법은 전면 폐지하도록 하고 특정범죄가중법의 경우 공무상 비밀누설의 가중처벌죄와 도주차량 운전자의 가중처벌, 위험운전 등 치사상죄를 형법전에 편입하였고, 나머지 부분은 폐지함이 타당하다고 생각된다. 성폭력특별법 및 청소년성보호법은 처벌 규정 중 형법에 규정되어 있지 않은 부분(친족관계에 의한 유사강간, 촬영물 등을 이용한 협박·강요죄 등)을 새로이 편입하였다. 처벌 규정은 모두 기본법인 형법전에 속하는 것이 적절하고, 성폭력특별법 및 청소년성보호법 중 형사소송법의 특례규정이나 성범죄자의 신상정보 등록·공개·고지 등의 절차적 규정만 남겨둬야 할 것이다.
이처럼 형사특별법은 임시법·예외법적인 특성에도 불구하고 한번 제정되면 폐지되기가 힘들다. 특히 성문법주의인 우리나라는 법률로써 존재하기만 하면 특별법 우선 적용의 원칙에 의하여 우선 적용해야 하므로 가장 중요한 부분은 형사특별법의 남입법을 방지하고 충분한 검토와 논의를 거쳐 제·개정해야 하는 사실일 것이다. 앞으로는 여론에 휩쓸려 중형주의에 입각한 형사특별법이 아닌 예외적인 부분에 대하여 규정하는 형사특별법이 제·개정되기를 바란다.; Currently, Korea has special acts on criminal affairs and
administrative criminal acts alongside the Criminal Act, which
is the framework act in criminal laws. However, special
criminal acts, which should be temporary and exceptional in
nature, have been legislated indiscreetly and therefore often
ifies and invalidates the Criminal Act that should function
as the framework act, causes imprudence and imbalance in
statutory punishment and has the risk of double punishment. In
addition, in practice, the massive volume and frequent
amendment of special acts become an excessive burden in
interpreting laws and create a discrepancy between statutory
punishment and reality.
This dissertation reviews four special acts on criminal
affairs: the Punishment of Violences, etc. Act; the Act on the
Aggravated Punishment, etc. of Specific Crimes
