Abstract
2000년부터 2007년까지 독일에서 외국인을 대상으로 살인과 강도 등 일련의 중범죄를 일으킨 국가사회주의지하조직(NSU)에 대한 수사가 부실하게 수행되었음이 드러나자, 2012년 독일 연방의회가 조사위원회를 구성하여 정보기관들에 대한 조사를 실시하였다. 2013년에는 스노든이 미국 중앙정보국(CIA)과 국가안보국(NSA)의 불법적인 감시활동을 폭로하자, 독일 내에서 이와 관련된 독일 연방정보원(BND)의 활동을 조사하고자 연방의회 조사위원회가 구성되었다. 이런 일련의 사건들로 말미암아 2016년 독일은 연방정보원법을 개정하여 그 동안 법적으로 회색지대였던 해외통신첩보활동에 대한 법적 근거를 마련하였다. 이를 통해 정보기관 활동의 효율성이 발휘되도록 노력할 뿐만 아니라, 정보기관이 법치국가 원리 하에 효과적으로 통제될 수 있도록 노력하였다. 연방정보원의 해외통신첩보활동은 독일의 외교・안보정책에 중요한 정보를 수집, 분석, 평가하여 독일의 외교안보정책에 기여하는 것을 목적으로 하고 있다. 다만 해외통신첩보활동은 해외에서 외국인들 간에 이루어지는 통신에 대한 감시를 주 대상으로 하기 때문에, 헌법적으로 통신의 자유 침해 및 독일인과 외국인에 대한 평등원칙 위반문제가 제기된다. 그러나 연방정보원법상 규정된 해외통신첩보활동은 전체적으로 볼 때 비례원칙에 위반된다거나 불합리한 차별이라고 볼 수 없어 위헌적인 법 상황이라고 평가할 수는 없다. 다른 한편, 연방대법원의 법관과 검사로 구성된 3인의 독립위원회라고 하는 기구가 새롭게 도입되어, 연방정보원의 해외통신첩보활동에 대한 사전적 통제를 담당하게 되었다. 독립위원회는 기존에 의회에서 조사위원회, 의회감독위원회, G10위원회 등을 통해서 통제되던 연방정보원의 활동을 사전적으로 통제한다는 점에서 차이가 있고, 의회나 행정기관이 아닌 사법기관적 성격을 가진다는데 차이가 있다. 다차원적인 통제기관의 활동을 확장하는 것이 좋은 것만은 아니지만, 최소한 연방정보원의 활동에 대한 법치국가적 원리를 실현하려는 구체적인 노력이라는 점에서 의미가 있다. 이러한 독일의 연방정보원법 개정과 현실에서의 변화는 우리 국가정보원을 대외안보와 외교정책을 위한 정보수집 업무를 주로 다루도록 개편하는 데 있어서 하나의 좋은 모범이 될 수 있다. After the sharp criticism of the Snowden revelations, by the legally unregulated overseas surveillance by the German Federal Intelligence Service (BND) and the cooperation with the US National Security Agency (NSA) turn out to be legally unproblematic, and the opaque role of the Constitution Protection Agencies of the Federation and the States in the terrorist complex case “National Socialist Underground (NSU)”, in 2016 the German National Assembly(Bundestag) passed a comprehensive reform of the Federal Intelligence Service and its control of authoritative legislation. On the one hand, the laws advanced the further development of the parliamentary control of the intelligence services on many levels, and in particular it create so-called “Independent Supervisor”. On the other hand, the German Bundestag has also the existing, but legally highly controversial practice of the so-called “Foreign-Telecommunications-Surveillance” by the BND legally standardized and thus previous regulatory and constitutional gap closed. According to the reasoning of the law, the central key rule is Article 6 (1) of the Federal Law. With this article the BND can collects, evaluates and processes, with technical means, information including personal data from telecommunication networks, through which telecommunication of foreigners abroad takes place, if these data are necessary, in order to find early threats for the internal or to secure external security of Germany or to serve foreign and security politics significance for the Germany. The few objections to the new regulations are the constitutional principles. For example, it does not take account of the applicability of fundamental rights abroad to foreigners, it unequally treats Germans and foreigners without any justifiable justification, or infringes the principle of proportionality. Despite all these critical remarks, reform of the BND stands out beneficially from the polemical noise. The novella is therefore to be rated as positive overall. In an international comparison, the BND's overseas surveillance activities are regulated with unprecedented detail, and thus also legally controllable. This BND refom is very helpful and suggestive of finding the right path to reform for the Korean National Intelligence Service (NIS).
