非選好施設 立地葛藤의 解消方案에 관한 硏究

Abstract

민선 지방자치시대 이후의 갈등은 민선자치시대 이전의 갈등과 그 양상이 매우 다르게 나타나고 있으며, 따라서 현재 발생하고 있는 갈등현상은 새로운 시각과 관점에서 접근할 필요성이 있다. 즉, 참여를 강조하는 민선자치시대 이후의 갈등은 통제를 강조하는 기존의 갈등해결시스템으로는 해결이 불가능함에도 불구하고 기존의 갈등해결시스템으로 접근하여 문제를 해결하려는 경향을 보이기 때문에 갈등해결과정에서 많은 문제점이 노정되고 있다. 따라서 기존의 갈등해결시스템의 문제점을 보완하고 갈등예방 및 조정기능을 강화할 수 있는 새로운 갈등예방 및 해결시스템 구축이 필요한 실정이다. 본 연구는 정부의 공공정책이나 사업을 둘러싼 지역갈등 사례들을 분석해 봄으로써 지역간 또는 지방자치단체 간 갈등의 원인 및 갈등의 조정과정에 영향을 미치는 요인을 도출해 내고자 한다. 즉 지역갈등의 발생원인 및 조건과 지역갈등의 악화 및 완화요인을 도출해 보고자 한다. 특히 이러한 사례분석 내용을 종합하여 지역갈등을 최소화하고 상호 협력을 유도할 수 있는 갈등예방 및 해결시스템을 제시해 보고자 한다. 본 연구의 결과 비선호시설 입지 갈등의 해소를 위해서는 우선 절차의 합리성과 참여의 확보를 위해서는 합리적 절차 마련을 통한 정책개선, 참여적 의사결정의 수용의 법적 근거 마련, 시민단체와 각계의 폭넓은 참여 수용이 필요하다고 할 수 있다. 다음으로 정책에 대한 신뢰성 확보와 합의를 위해서는 비선호시설의 인식전환 노력, 점진적 논의지향의 협상의 추구, 광역적 접근과 협의문화의 정착과 정책논쟁의 다각적 조명이 요망된다. 그리고 실질적인 갈등관리를 위해서는 경제적 보상과 지원체계가 구축되어야 하며 이를 위해서는 장기적인 계획을 통한 정부정책사업의 마련, 합의가 가능하도록 적절한 인센티브가 효율적인 해소방안이라고 할 수 있다. 그리고 무엇보다 비선호시설의 입지선정을 둘러싼 정책갈등을 효율적으로 해결하기 위한 마지막 단계에서의 전략으로는 정책조정과 리더십이 중요한데, 여기에는 조정의 활용, 부서나 집단 통합 또는 분리, 갈등해결 지연에 따른 새로운 갈등 가능성 고려가 필요하다. 결론적으로 바람직하지 않은 정책갈등을 예방하고 발생한 갈등해결의 효과성을 높이기 위해서는 참여적 의사결정방식을 접합한 갈등관리시스템을 구축할 필요가 있다. 특히 온라인 정보통신기술의 급속한 발전은 비밀스런 정책결정을 거의 불가능하게 만들었으며, 정책의 투명성 확보를 각종 주요시책이나 정책결정에 있어서 중요한 정책가치로 부상시켰다. 또한 정책결정단계에서의 시민의 참여 확대는 정책투명성 확보의 필요조건이 되고 있다. 마찬가지로 비선호시설 및 혐오시설의 입지선정에 있어서는 시설의 필요성을 인식하고 기준을 정하는 기초단계에서부터 시민참여가 적극적으로 이루어질 수 있도록 제도적 장치를 마련하는 것이 갈등으로 인한 정책비용을 줄이고 정책의 정당성을 확보하는 중요한 요소가 된다.; Conflict is one of the common and critical issues in the process of locating locally unwanted land uses. Recently, conflict over land uses for public facilities has much impacts on the economic growth and social stability. But it is not yet devised what kinds of principles and strategies are effective to settle the conflict. Local governments will experience more conflicts with their people over land uses for public facilities. In order to successfully manage such conflicts, it will be necessary to explore effective solutions to the policy conflict problems, while reinstating efficiency and reliability for the design and implementation of the policies. In this respects, this study attempted to find out some alternatives for resolving conflicts in the process of locating locally unwanted land uses. In order to achieve the purpose of this study, relevant literature was researched into theoretically, while cases were collected from preceeding studies, raw data, periodicals, dissertations and reports. As the results of this study, some alternatives and strategies for resolving conflicts in the process of locating locally unwanted land uses were suggestedfor the effective management of conflict in the process of policy on locating locally unwanted land uses as follows: First, the government needs to provide the residents with the opportunity to participate in policy making and the channels to input their opinions and requirements. Second, the government should offer the exact information about construction and operation of the facilities. Third, government has also to provide them with the economic compensation to reduce their negative impact from the facilities. Finally, as the participation-oriented approach contribute to the solution of conflicts, continuous efforts should be exerted in order to give more information quickly and clearly and get more participation and cooperations from the residents.
