시장에서의 한국 시민사회의 역할

Abstract

본 논문의 목적은 민주주의와 자본주의로부터 발생하는 시장 문제를 해결하는데 있어 시민사회의 역할을 강조하고, 사례분석을 통하여 시민사회가 구체적으로 시장 문제 해결에 있어 어떠한 역할을 하는지를 고찰하는 데에 있다. 우리나라를 비롯한 많은 국가들은 시민들의 자유와 경제성장을 실현하기 위해서 민주주의와 자본주의를 채택하고 있고, 역사적 경험에 비추어볼 때 민주주의와 자본주의는 시민들의 자유와 평등의 실현에 있어 최선의 방법이었다. 그러나 민주주의와 자본주의 원리를 추구하는 국가에서는 자유와 불평등이라는 상반되는 이념의 문제가 발생하게 되었고, 이로 인해 시장 문제가 야기되었다. 시장은 생산자와 소비자들이 연결되고, 상호 작용하는 경쟁의 공간으로서, 자원분배의 조정기능을 담당하지만, 불완전 경쟁시장에서는 그 기능을 제대로 수행할 수 없게 되고, 이로 인해 기업 독점 문제와 개인보호 문제 등이 발생하게 되었다. 기업은 시장에 독점적 지위를 확보할 수 있게 됨에 따라 기업 내 문제 관심을 가지게 되었고, 내부 장악을 통하여 기업 경영을 독단적으로 실시하게 되었으며, 하자(瑕疵)나 흠이 있는 불완전한 상품을 생산하여 시장에 공급하게 됨으로서 시민들은 커다란 피해를 입게 되었다. 이와 같은 시장 문제의 해결을 위해 정부와 기업은 지속적으로 역할을 하였으나, 정부는 경제성장을 추구하고, 기업은 이윤추구를 목적으로 활동하였기 때문에 시장에서 제 역할을 담당하지 못했고, 시장 문제에 대한 정부와 기업의 한계로 인해 정부와 기업이 아닌 다른 행위자에 의한 시장의 해결 방안이 모색되었고, 이를 보완할 수 있는 제3 섹터로서 시민사회의 역할이 강조되었다. 시민사회는 민주주의와 자본주의에서 발생하는 시장의 문제에 있어 필수적인 역할을 담당한다. 특히 본 논문에서는 참여연대의 소액주주운동과 한국소비자연맹의 소비자보호활동을 통해 시민사회의 역할을 조명해 보았다. 참여연대의 소액주주운동의 경우 소액주주들의 권리를 보장하기 위한 운동을 전개하여 기업에 대한 소액주주들의 경영참여의 기회를 도모하는 등 기업 독점의 문제에 대한 시민사회의 역할이 부각된 대표적인 사례라고 할 수 있으며, 한국소비자연맹의 소비자보호활동의 경우 기업에 대한 피해와 예방 그리고 교육 활동 등을 전개하여 기업에 대한 소비자들의 권리 보호를 도모하는 등 개인 보호 문제에 대한 시민사회의 역할이 부각된 대표적인 사례라고 할 수 있다. 이와 같이 본 논문에서는 시장 문제의 해결에 있어 필수적인 부분을 담당하는 시민사회의 역할을 살펴보고자 하며, 구체적인 사례로서는 소액주주들의 권익 보호를 위해 추진되었던 참여연대의 소액주주운동과 소비자들의 권익 보호를 위해 추진되었던 한국소비자연맹의 소비자보호활동을 통해 시민사회의 역할에 대한 평가를 내려 보고자 한다.; This dissertation aims to emphasize the role of civil society in resolving problems arising from the "free-market" promoted under the underlying framework of democracy and capitalism. Many countries including Korea have embraced democracy and capitalism for achieving the values of freedom and equality. Historically, democracy and capitalism were the best methods in guaranteeing civil freedom and economic growth. However, countries pursuing the spirits of both democracy and capitalism at the same time have been confronted with problems caused by inter-contradictory ideals of freedom and inequality. Thus, serious free market problems have arisen. The free market offers a setting where the producers and consumers freely interact, allocating resources through an open-end competition. But in an incomplete non-ideal market environment, dysfunctional free-market leads to a series of problems including monopoly and failure to protect individual consumers. Over time, companies have tried to monopolize the market. They started to turn inward engaging in internal power struggle and made arbitrary management through solidified power of the management, eventually leading to the release of incomplete flawed goods and services to the market. The general consumers have fallen victim to such a mismanaged free-market system. Although the government and companies have worked continuously to fix the problems of the market, the results have been unsatisfactory because of the pursuit of economic growth by the government and of profit by the companies. Due to the underlying limitations the government and companies face, civil society's role has been sought to make up for their incomplete functions as a third sector. Against this backdrop, the civil society has played an essential role in resolving free-market problems arising from a democratic and capitalist system. Highlighted in this study as examples of the essential role of civil society are the movement of protecting minority shareholders initiated by the People's Solidarity for Participatory Democracy and consumer protection campaign launched by the Consumer Union of Korea. The case study of minority shareholders protection illustrates the strengthened complementary role of civil society in restraining monopolistic company position in the free-market by ensuring minority shareholders' rights and their participation in company management. The campaign for consumer protection demonstrates civil society's role for raising awareness of and protecting the interest of individual consumers against companies. In sum, this dissertation underscores the essential role of civil society in resolving free market problems and takes notes of particular roles played by the civil society through the movement of protecting minority shareholders and individual consumers.
