범죄피해 청소년에 대한 보호 및 지원 제도에 관한 연구

Abstract

본 논문은 형사사법의 새로운 패러다임의 변화를 가져온 범죄피해자에 대한 종합적인 보호 및 지원의 제도적?정책적 대안을 모색해 보고자 하는 관점에서도 청소년을 대상으로 기술하였다. 국가의 국민의 생명, 자유, 재산을 보호해야할 당연한 임무와 인간존엄성의 실현을 위한 범죄피해의 신속한 회복이라는 시대의 변화에 따라 범죄피해자는 이제 범죄로 인한 피해를 보상받아야하고, 범죄피해자는 국가로부터 실질적 피해회복에 필요한 도움을 받아야한다는 인식으로 범죄피해자는 이제 적극적 권리주체자로 인식되고 있습니다. ‘청소년’을 떠 올리면 ‘비행’, ‘문제행동’ 및 ‘폭력성’ 등만을 떠올릴 뿐 ‘피해자로서의 청소년’은 관심의 대상 밖이었다. 하지만 만 20세이하의 범죄피해자가 전체 폭력범죄 피해자의 7.4%를 전체 강간피해자의 28.8%를 차지하고 있고, 전체 성범죄피해자의 28.1%를 차지하고 있다는 점과 청소년의 범죄피해의 결과는 성인에 비해 훨씬 심각하다는 점을 고려하여 본 연구에서는 청소년 범죄피해자의 보호와 지원에 대한 현황과 문제점을 살펴보고, 종합적이고 체계적인 대안을 제시하고자 하였다. 서구 선진국에서는 이미 지난 1950년대 피해자학의 발전에 따라 1960년대 범죄피해보상제도가 마련되기 시작하였고, 이후 국가적 차원의 대책들이 추진되어 범죄피해자의 피해회복과 피해자화 방지를 위해 노력하였다. 우리나라도 최근 국민의 인권의식과 흉악해지는 범죄피해에 대한 사회적 관심이 비등해 지면서 범죄피해자를 적극적으로 보호해 주며 그들의 피해회복에도 국가가 제도적?정책적으로 지원해주어야 한다는 요구에 국가기관도 서서히 그 필요성을 인식하는 시점에 와 있다. 청소년기에 범죄피해를 입었음에도 불구하고 이에 대한 보호나 지원이 제대로 이루어지지 않게 되면 범죄피해에서 회복되거나 피해를 극복하지 못하게 되어 피해로 인한 상처가 평생에 걸쳐 고통을 줄 수 있다. 특히 우울증, 성격장애 및 스트레스증후군과 같은 정신건강의 문제뿐만 아니라 가출, 약물이나 마약남용과 같은 문제행동이나 비행행동, 나아가 자살에까지 이르게 되는 치명적 결과를 낳을 수 있다. 앞으로 효율적인 범죄피해자 지원체계를 마련하기 위해서는 범정부적인 지원체계의 구축과 국민의 관심제고가 선행되어야 하며 이를 바탕으로 사회 복지적 차원의 지원이 더욱 강화되어야 할 것이다. 그리고 미국이나 일본 등 선진국의 예에서 보듯이 국가의 예산으로 민간의 자원봉사자들이 지원활동을 할 수 있는 시스템이 정착되도록 민간단체의 육성에 노력하여야 할 것이며, 국제적인 협력에도 적극 관심을 가져야 할 것이다.; This treatise is described for juvenile in terms of groping institutional, politic counterplan about comprehensive protection and support to criminal victims, which cause change of new criminal law paradigm. According to era's change of national natural duty to preserve life, liberty, property of citizen and prompt recovery from criminal damage for realization of 'the dignity of man', criminal victim is now regarded as active subject of right by recognition that criminal victim should be compensated for damage from crime and should receive help which is needed in substantial damage recovery from government. "Juvenile" is reminded as "Delinquency", "Trouble behavior" and "Violent propensity" instead of "Juvenile as a victim" in the research considering the point that but at least 20-year old criminal victims occupy 7.4% of total violence criminal victims, 28.8% of total rape criminal victims, 28.1% of total sex criminal victims and the fact that result of juvenile criminal damage is more serious than that of adult, the present condition and problem about protection, support to juvenile criminal victims are inspected and overall, systematic counterplan is meant to be proposed. In western advanced country, by 1950's development of victimology, institution of criminal damage compensation is launched and since then by launching national measures, it tries for recovery of criminal victims and obviation of victimization. In korea, as recent national consciousness of civil rights and social interest in more atrocious criminal damage are becoming similar, the government is at the point of recognizing that necessity for request of institutional, politic support to criminal victim's recovery and active protection of criminal victims. Despite a juvenile gets criminal damage, if that juvenile get no protection or support properly, that juvenile will suffer with wound from damage throughout his or her life because of no recovery form criminal damage and no conquest of damage. Especially It can cause critical consequence of not only mental health problem just like depression, personality disorder, stress injury but also problem behavior, delinquency just like runaway and drug abuse and in the event suicide. construction of governmental support system and raise of national interest should be preceded to prepare efficient criminal victim support system afterward and based on this, social, welfare support should be more strengthened. And upbringing of a private organization and active concern about international cooperation should be encouraged to settle down system that private volunteer can do support activity with national budget as we can find example of an advanced country just like America, Japan.
