한-미 자유무역협정에서의 서비스교역 규율 및 법률시장 개방에 대한 법적고찰

Abstract

서비스라 함은 상품과 달리 눈에 보이지 않고, 저장할 수 없는 무형의 인간의 노력을 의미한다. 상품과 다른 독특한 특성을 가지고는 있지만, 명확히 정의하기 어렵기 때문에 서비스교역에관한일반협정(GATS)에서도 정의규정을 두고 있지는 않고, 서비스교역이 주로 자본의 국경 간 이동과 인력의 국경 간 이동의 형태로 이루어지고 있으며 이외에도 서비스제품 자체가 국경을 넘는 경우와 서비스의 소비자가 국경을 넘는 경우가 있음에 착안하여 서비스교역의 4가지 유형을 규정하고 있다. 상품교역에 대한 제한이 주로 관세부과 조치의 형태로 이루어진다면 서비스교역에 대한 제한은 외국인에 대한 차별 또는 서비스산업 시장 자체에 대한 진입을 제한하는 형태로 국내법에 의해서 규율되고 있다. 따라서 서비스교역에 대한 협상은 결국 이러한 서비스교역에 대한 차별 또는 제한조치를 담고 있는 국내법을 외국인에 대한 차별조치를 없애고 서비스산업 시장에 대한 진입을 자유롭게 하는 내용으로 개정하도록 하는 문제를 논의하는 협상이다. 이러한 서비스교역 협상의 방식으로는 투명성을 증진하고 높은 수준의 개방효과를 누리고자 하는 방식인 Negative 방식과 개방수준은 낮지만 원하는 서비스산업만을 선택하여 개방할 수 있는 방식인 Positive 방식이 있는데, 한-미 FTA 서비스교역 협상에서는 전자인 Negative 방식을 사용하여 협상을 체결하였다. 서비스교역을 규율하는 규범에는 다자간규범인 서비스교역에관한일반협정(GATS)과 양자간 규범인 FTA 서비스협정 등이 있는데, 동 규범에 의하여 논의되는 일반적인 의무사항으로는 시장접근제한 금지의무, 내국민대우의무, 최혜국대우의무 등 다자간 규범과 양자간 규범에서 공통으로 논의되는 의무와 현지주재요건부과 금지의무, 이행요건부과 금지의무, 이사회 및 경영진에 대한 국적요건부과 금지의무 등 양자간 규범에만 논의되는 의무가 있다. 한-미 FTA 서비스협정문에서는 위에서 언급된 일반적인 의무사항 뿐만 아니라 양자간의 자유로운 서비스교역을 보장하기 위한 추가적인 의무사항을 규율하고 있다. 본 논문에서는 서비스교역 및 서비스교역 협상의 의의, 서비스교역을 규율하는 다자간 규범인 서비스무역에관한일반협정(GATS)과 대표적인 양자간 규범인 NAFTA의 내용을 살펴보고, 한-미 FTA에서는 서비스교역을 어떻게 규율하고 있는지 또한 한-미 FTA 서비스교역 협상을 통하여 양국의 서비스산업은 어떻게 개방되었는지 마지막으로 한-미 FTA를 통하여 최초로 수준 높은 개방을 한 법률서비스 시장의 개방에 대하여 검토함으로서 서비스교역 협상을 전반적으로 이해하고, 한-미 FTA 서비스교역 협상의 의의와 쟁점을 나름대로 연구하였다. 이러한 검토를 위해서 본 논문에서는 각종 국·내외 국제법 교과서와 법무부, 농림부(현 농림수산식품부), 재정경제부(현 기획재정부)에서 발간한 단행본과 참고자료, WTO 서비스교역 관련 분쟁사례 그리고 각종 서비스교역 협상 관련 국·내외 논문들을 참고로 연구하며, 서비스교역 협상을 실제로 경험하면서 알게 된 내용 등을 정리하였다.; Compared to goods, services are humane labor which are intangible, invisible and non-storability. Services have unique characters however, because it is hard to describe exact definition, GATS only covers four types of trade in services. Those are cross-border supply, consumption abroad, commercial presence and presence of natural persons. Limitation to trade in goods are imposed by the form of levying customs duties, limitation to trade in services are imposed by the form of discriminative treatment to foreigners or not allowing to access to the services industry market according to the relevant domestic law. So in the services negotiation, we discuss about the problem of abolish or modify that relevant domestic barriers. There are two representative methods in the services negotiation, one is the Negative list approach by which we can promote mutual transparency and level of opening, the other is Positive list approach by which we can choose the sectors of service which we want to open. In KORUS FTA services negotiation, we used the method of Negative list approach which is the way if we don't list up current measures to restrict or future power to restrict, existing laws become to be nullified or we can not make new domestic law to discriminate foreigners in the future. There are GATS and several regional agreements that regulate trade in services, MA, NT and MFN are common obligations in GATS and regional agreements for example FTA. LP, PR and SMBD are special obligations in regional agreements. KORUS FTA services text regulate these several obligations and additional rule to guarantee trade in services liberally. In this report, I am going to study on general theory about trade in services, GATS, service text of KORUS FTA, the principle results of services negotiation and result and effect of legal services. To try to this job I refer to several texts of International law, study book published by MIFAFF, MOFAT and MOJ and studies on services negotiation. And I try to arrange my personal business experience and ideas.
