한국의 무용저작물 보호에 관한 연구

Abstract

본 논문은 한국의 무용저작물 보호에 관한 연구이다. 현재 문화계 전반에서 관심이 증대되고 있는 저작권을 무용부문에 접목하여 살펴봄으로써 저작물 보호에 대한 중요성을 알 수 있다. 무용계에서 안무된 작품들에 대한 표절의혹이 예전부터 끊임없이 발견되어오고 있음에도 불구하고 무용인들의 낮은 권리의식과 저작권법에 대한 무지로 인해 표절과 도용에 대한 구제 및 해결이 힘든 상황에 있다. 무용저작물은 예술장르 중에서도 특수한 분야로 인정되고 있지만 아직까지 저작권으로 보호되는 무용의 범위에 대해서 특별한 규정을 두고 있지 않다. 2006년도 개정된 저작권법 내에서도 연극저작물에 인접한 저작물로 인식되고 있다. 최우선적으로 무용저작물이 지니는 각각의 권리들을 구분 지어야하며 법에서 정의하는 안무가 무엇을 포함하고 무엇을 포함하지 않는지에 대한 구체적인 범위를 규정지어야 한다. 국내외에서 무용저작물 분쟁 사례들을 통해 알 수 있듯이 안무가, 무용각본, 무용사진, 안무동작으로 구분지어 설명할 수 있으며, 결합저작물에 해당되는 국내무용분야에 대한 체계적인 저작물 보호를 위해 무용인들은 더욱 노력해야 한다. 이상의 저작권배경과 무용저작물 분쟁 사례들을 기반으로 하여 한국의 무용저작물에 대한 구체적인 보호방안으로써 제시한 내용은 다음과 같다. 첫째, 무용저작물의 인식개선으로써 이해관계자들(무용저작자, 실연자, 이용자), 연극저작물로서의 보호, 독창적인 무용의 범위개선 방법들을 제시하였다. 둘째, 무용저작물 신탁관리단체 조성을 제시하였다. 기존의 신탁관리단체의 활용과 새로운 무용저작물 신탁관리단체 설립에 따르는 과제와 문제점들을 설명하였다. 셋째, 무용저작물 등록 활성화이다. 현재 저작권위원회에 무용저작물이 한건도 등록되어있지 않은 안타까운 현실을 벗어나기 위해서는 일반적인 저작물 등록절차를 숙지하여 실행해야 하며 증거물(무보, 영상물) 또한 포함시켜 등록하여야 한다. 무용저작물에 관한 인식과 권리의식 제고, 무용저작물 신탁관리 단체 조성, 저작물 등록과 같이 구체적인 무용저작물 보호방안을 제시함으로써 앞으로 무용분야의 저작권발전에 대한 토대를 마련할 수 있는 중요한 연구로 생각되어진다.; This paper discusses the protection of Korean dance works. The importance of the protection of dance works is identified by observing the copyright which is gaining interest in the overall art world in connection with the dance field. In spite of the continuous suspicions of plagiarism on the choreographed dance works, the plagiarism and surreptitiousness are hardly redeemed or solved due to the low awareness and ignorance of the dancers on the copyright law. Although the dance works are recognized as the special art genre, no special regulation has been set for the scope of dance that is protected by the copyright. The amended 2006 copyright law still recognizes it as contiguous to the play works. First and foremost, each right to the dance works shall be classified and the specific scope of the choreography to be included in the definition of law shall be set forth. As seen from the domestic and overseas dispute cases surrounding the dance works, the scope can be classified to choreographer, dance notation, dance photo, and dance motion. The dancers and the related must strive for the systematic copyright protection for the combined works in Korean dance field. Based on the background of copyright and dispute examples mentioned above, the below is the proposal for specific plans of protecting Korean dance works. First, for improved recognition to the dance works, the improvement plans for stakeholders (dance copyright holder, performer, user), protection as the play work, and the scope of creative dance were proposed. Second, the establishment of dance work trust administrator group was proposed. The utilization of the existing trust administrator group as well as the expected issues and problems upon the establishment of new dance work trust administrator group were described. Third, the active dance work registration was proposed. In order to overcome the tragic reality that not one dance work is registered to the copyright commission, the generic copyright registration process must be learned and implemented, and the evidence (dance notation, video) must be included in the registration as well. It is considered that this is a meaningful study in establishing the foundation for the improved copyright status in the dance field by proposing the specific plans of protecting the dance works including enhancement of recognition and awareness of the copyright of dance works, establishment of dance work trust administrator group, and the copyright registration.
