地方議會議員의 住民代表性 提高方案에 관한 硏究

Abstract

본 연구는 地方議會의 住民代表性을 提高하기 위한 方案을 提示하는 데 목적이 있다. 이러한 目的을 達成하기 위하여 서울특별시 江南區議會의 議政活動과 주민의 認識에 대한 실증적 분석을 토대로 地方議會의 대표성을 制約하는 요인들을 도출하고 이러한 문제점들을 克服하기 위한 方案을 提示하는데 목적이 있다. 본 연구는 江南區議會의 議政活動에 대한 현황분석에 있어서는 1998년부터 2006년까지의 의정활동을 대상으로 하였으며 연구방법으로는 文獻調査方法과 함께 설문지에 의한 現場調査(field survey by questionaire)을 사용하였다. 江南區議會의 의정활동과 의원들의 대표성에 관한 주민의 인식을 實證的으로 분석하기 위하여 江南區에 居住하는 주민 200명을 대상으로 설문지에 의한 意見調査를 실시하여 이 分析結果를 연구에 활용하였다. 그리고, 硏究者가 地方議政活動을 통해 몸소 體驗한 經驗과 다른 地方議會議員이나 擔當公務員들로부터 知得할 수 있었던 問題點과 改善方案을 연구에 참고하였다. 본 연구의 결과 우선 제3장의 강남구민들의 인식조사 결과 地方議員 이름의 인지 여부에 있어서는 이전에 비하여 지방의원에 대한 인지도는 상당히 向上된 것으로 조사되었다. 의회의 각 기능에 대한 인지도에 비교적 낮은 편으로 나타났으나 地方議員의 活動에 대한 만족도는 긍정적인 대답이 부정적인 대답보다 더 높게 나타났다. 지방의원의 주민대표성에 대한 평가에서는肯定的인 응답이 否定的인 응답보다 더 높게 나타났으며 의회기능별 주민대표성에 대한 평가에 있어서도 대체로 50%이상이 긍정적인 評價를 하고 있는 것으로 나타났다. 본 연구에서의 그동안 우리나라의 地方議會에 관한 연구를 종합적으로 검토하고 또한 본 연구에서의 實證分析을 토대로 우리나라 지방의회의원 住民代表성의 제약요인은 첫째, 지방의회의 미약한 權限 둘째, 지방의회의 自律性의 제약, 셋째, 주민욕구의 多樣性과 참여의식 부족으로 요약될 수 있다. 결론적으로 지방의원 주민대표성의 제고방안은 첫째로 지방의회의 議決權의 확대를 위해서는 地方自治法 개정을 통한 의결권의 확대, 행정사무감사 및 조사의 실효성 확보, 정보의 공유를 들 수 있으며 둘째, 입법기능의 강화를 위해서는 條例立法範圍의 확대 및 實效性 확보, 국가의 입법과정에 지방자치단체의 의견제안제도 도입방안을 제안 할 수 있다. 셋째, 의정활동의 전문성 강화를 위해서는 의회사무기구의 정책보좌기능 강화, 專門委員制度의 개선, 위원회제도의 활성화, 전문연구기관 등의 구성과 활용, 의원의 연수기회 확대 및 內實化를 기해야 할 것으로 판단한다. 넷째 執行部와의 協議體系 構築이 필요하다고 할 것이며 이를 위해서는 사전협의제도의 도입, 자치단체장의 議會牽制機能 축소, 집행부와의 갈등 해결을 위한 다양한 방안을 강구하는 것이 필요하다. 다섯째, 議會位相定立과 效率的 運營을 위해서는 위원회 제도의 확대 및 활성화, 의원정수의 自律的 調整, 의안제출요건의 緩和가 필요하다고 본다. 마지막으로, 주민의 參與와 認識을 제고시킬 필요가 있으며 이를 위해서는 지방의원의 주민대표성에 대한 인식 제고, 議政弘報 및 의정참여강화와 특히 주민교육과 주민과 함께하는 지방의정에 관한 세미나와 討論會를 定例的으로 開催하여 지방의회의 市民意識 先導機能을 强化하는 것이 필요하다고 사료된다.; Local council is a representative organization for residents in the process of local autonomy. It has such role as making policy, examining the budget, intermediating the citizen's petition and inspecting and controling the executive body of the local governments. Accordingly, the success of the local autonomy largely depends on the role of local council and the representativeness of the local councilmen. This study aims at suggesting some alternatives for enhancing representativeness of local councilmen in the process of local administration. This study is based on empirical analysis by field survey focused on Gangnam-Gu council and in order to review the theoretical background, books, articles and dissertations are examined. As results of this study, the main factors that limits the function and the representativeness of local council are : (1) absence of sufficient legal rights of local council, (2) diversity of needs and lack of citizens' participation. (3) absence of power to control executive body and citizens who break the laws made by local council. (4) lack of time and knowledge required for the examining the budget and policy alternatives (5) weakness of advisory function of the secretary office In this study, as a conclusion, following alternatives are suggested for enhancing the role of local council and the representativeness of the local councilmen. 1. Providing local council with sufficient legal rights for making law and regulations. 2. More time for examining the budget and policy agenda. 3. More cooperative relationship between local council and executive body in order to share informations needed for deciding the policies. 4. Enhancing the citizens' consciousness on the role of local council by giving more informations on the activities of local council and allowing more citizens' participation 5. Strengthening the educational function for the local council.
