Abstract
본 연구는 음주운전자의 특성과, 음주운전 억제정책의 효과를 분석하였다. 음주운전을 억제하기 위한 수단은 징벌적 요소로써 형벌, 행정처분(운전면허의 취소 또는 정지)이 있으며, 유인적 요소로써 교육이 있다. 이러한 억제정책의 효과를 분석함과 아울러 음주운전 모형을 개발함으로써 보다 효과적인 억제정책을 개발하는 것이 본 연구의 목적이다. 본 연구에서는 세 가지 자료를 수집하였다. 첫쩨 2006년 부산 금정경찰서에서 음주운전자를 수사한 의견서 기록이며, 둘째음주운전으로 인하여 운전면허가 정지된 사람에 대하여, 셋째, 음주운전으로 운전면허가 취소된 운전자의정지․ 취소처분을 받은 이후 5년간 운전행태를 추적한 자료이다. 본 자료를 대상으로 음주운전자의 특성을 살펴보았으며, 음주운전 억제정책의 효과는 형벌, 운전면허 취소 및 정지, 교육이수 여부별로 분석하였다. 음주운전모형은 재범기간, 벌금영향모형을 개발하였다. 음주운전자의 특성은 자료의 기술적 통계량으로 분석하였고, 억제정책의 효과는 각 효과척도별로 t테스트 검증, 분산분석방법을 활용하였다. 그리고 음주운전 재범모형은 로지스틱 회귀분석 방법을 이용하였으며, 재범기간 및 벌금영향모형은 다중회귀 분석 모형을 이용하였다. 연구결과는 다음과 같다. 첫째, 음주운전자 특성분석 결과 형사전과자, 무면허, 교통사고 발생자 등 법규 준수성향이 낮은 운전자가 음주운전 재범을 많이 하였다. 둘째, 형벌의 경우 징역형은 음주재범기간이 길어 음주운전 억제의 효과가 있었으나 벌금형의 경우에는 벌금이 많아도 재범기간이 길어지는 특성이 없는 것으로 나타나 음주운전 억제효과는 나타나지 않았다. 형벌강화에 의한 혈중 알코올 농도 감소효과도 확인되지 않았다. 행정처분은 면허취소처분이 면허정지처분보다 효과가 더 큰 것으로 나타났다. 교육의 기회가 많을수록, 체험식 교육일수록 음주운전 억제효과가 큰 것으로 나타났다. 셋째, 재범기간모형, 벌금예측모형을 개발하여 홍보함으로써 줄일 수 있을 것이다. 이러한 연구는 음주운전 억제정책 개발의 논리적 기초로 이용될 것이다.; The objective of this study is to analyze the characteristics of DWI offenders according to the criminal status and the effectiveness of criminal punishment, administrative measure, and education on DWI offenders. The official DWI deterrence policies are criminal punishment, administrative measures(revocation or suspension of a driver's licence), and education. Hence, this study attempted to analyze the effectiveness of DWI deterrence policies of the police and develop a "repeated DWI offenders model". This study further proposed a plausible method to predict the level of fine according to the driver's respective status as one of the DWI deterrence countermeasures. This study took advantage of two types of data. One is Written Opinions of investigation on DWI offenders in Geumjung Police Station in Pusan 2006. The other is chasing records of five years of the traffic behaviors of those whose driver's licence was cancelled or suspended in 2003 for DWI. The characteristics of DWI offenders are analysed according to the first and repeated offenders, BAC(Blood Alcohol Concentration) and punishing amounts by using descriptive statistics. The deterrence effectiveness is analysed according to the punishment, administrative measures, and educated or not by using t-test and F-test. Models were developed by using logistic regression and multiple regression analysis method. This study discovered several interesting findings. Drivers with low law abiding propensity(e. g., criminal records, non licensed, traffic accident records) offend repeated DWI more. Those who had been imprisoned showed longer durations of repeated DWI than those who had been fined, which proved deterrence effects of incarceration. However, more amounts of fine resulted in shorter durations of repeated DWI, which suggested little effect of fine on deterring DWI. Lastly, severer punishment did not reduce BAC. With regard to the administrative measures, revocation of driver's license was related to lower rates and longer durations of repeated DWI than suspension does. And chronic DWI offenders showed higher rates and shorter durations of repeated DWI than their non-chronic counterparts did. Finally, tests of the education effectiveness proved deterrence effects of traffic education on DWI recidivism. Those study results suggested several policy implications. First, a renewed regulation must be passed to make possible a short-term imprisonment(e.g., 2-3 days) for DWI, especially for chronic DWI offenders, which will be able to reduce recidivism rates of DWI. Second, driver's license should be cancelled for DWI with a certain period of suspension of cancellation. The fear of cancellation makes drivers keep rules better than cancellation itself does. Third, traffic education for DWI offenders should be expanded. Particularly, participation or discussion in class has to be more emphasized than one-way lecture. Periodic and well-organized education will contribute to reducing DWI offenses by informing the offenders of possible punishments and disadvantages.
