전환 정액일괄도급 계약방식 프로젝트의 리스크 분석

Abstract

최근 원유가격의 상승, 대규모 생산능력의 플랜트 건설, 가용한 EPC 계약자의 한계, 국제 원자재 가격 상승, 환율불안, 기자재 가격 상승 그리고 노무비의 상승 등 시장 환경의 변화 속에서 전통적인 정액일괄도급 계약형태는 발주자에게는 프로젝트 수행비용의 증가와 일정의 장기화라는 리스크가 발생하고 계약자에게는 원가 경쟁력의 약화라는 리스크를 동시 동반하게 된다. 이와 같은 시장 및 사업 환경의 변화를 극복하기 위해 발주자와 계약자의 리스크를 동시에 줄이는 방안으로 새롭게 도입되고 있는 계약방식이 전환 정액일괄도급 계약방식 (converted lump-sum turnkey, CLSTK) 이다. 본 연구를 통해 전환 정액일괄도급 계약의 발주자는 리스크를 최대한 계약자에게 전이하려는 경향이 있어 계약자에게는 통상적인 정액일괄도급 계약과 다른 새로운 형태의 계약적 리스크가 발생할 수 있음을 알게 되었고 전환 정액일괄도급 계약의 리스크를 실제로 수행한 사례 프로젝트를 통해 도출하고 분석하였다. 도출된 리스크를 분석한 결과 리스크는 프로젝트 목표 중에서 특히 일정과 비용부분에 많은 영향이 있음을 알게 되었다. 아울러 본 논문은 계약자가 발주자와 투명성을 지속적으로 유지하면서 프로젝트 목표를 달성하기 위한 전환 정액일괄도급 계약수행에 적합한 리스크 경감방안을 제시하였다.

Therefore in order to overcome the changes in the market and plant project construction industry, Converted Lump-Sum Turnkey Contract has emerged has been started to apply in plant construction market . It depends on the application method and can be applied to various different types of contracts. This thesis was focus to find the associated risks and analyse the identified risks on recent trend of application of the new contract type, Converted Lump-Sum Turnkey Contract involved using exampled projects. It was recognized from the analysis that quality and cost have more high priority risks than other project objectives. This paper also suggest from the viewpoint of an EPC contractor, keeping transparency with Owner, the mitigation plan for identified risks to achieve project objectives appropriate to Converted Lump-Sum Turnkey Contract.
