사이버공간에서의 모욕죄 관련 판례 연구

현대는 소통의 시대이다. 자신의 생각과 의사를 표현하기 좋아하는 세대에게 인터넷이라는 공간은 게시판의 글 또는 기사를 읽고 자신의 의견이나 느낌을 표현할 수 있는 댓글달기는 새로운 여론을 형성하는 인터넷 문화로 정착되고 있다. 이 연구는 최근 인터넷에서의 쟁점으로 부상하고 있는 인터넷에서의 모욕죄 적용의 실태와 문제점을 살펴보기 위해 관련 법 규정 판례 그리고 기존 모욕죄의 법리를 고찰 하였다. 인터넷의 표현의 자유를 폭넓게 보장해주는 익명성의 뒤에 숨어서 유언비어 및 욕설과 명예 훼손적 발언 등을 거침없이 쏟아내는 악플러들의 악성댓글이 최근에 발생한 유명 여배우의 자살의 동기가 되었다는 사실이 밝혀져 사회적 파장을 낳았다. 사이버 모욕죄란 사이버 공간에서 공연히 사람을 모욕함으로써 발생하는 범죄이다. 사이버 모욕죄의 신설목적은 사이버공간에서의 자율적인 의사소통과 건전한 사이버 공간의 댓글문화형성을 저해하는 무분별한 폭력적·공격적 의사 표현을 규제하기 위한 것이다. 사이버 모욕죄를 신설하되 형법상 모욕죄와는 달리 친고죄가 아닌 반의사불벌죄로 하고 그 법정형도 가중하겠다는 것이 주요한 내용이다. 사이버 모욕죄 도입 따른 인터넷에서의 자유로운 의견제시가 위축되고 나아가 인터넷의 익명성을 제한하여 표현의 자유를 제한할 것이라는 우려의 목소리가 나오고 있다. 비록 몇몇 악플러에 의한 익명성의 악용으로 인터넷에서의 표현의 자유를 촉진하는 익명성의 순기능적 역할이 퇴색되어 버렸지만 예로부터 익명성의 보장은 권력에 대한 건전한 비판에 주요한 역할을 담당하였다. 이와 같이 사이버 모욕죄 도입에 대한 논란은 사회적 이슈로 자리 잡고 있다. 사이버 모욕죄 신설에 따른 제고되어야 하는 인터넷에서의 표현의 자유의 과도한 제재와 이에 반하는 개인의 인격적 침해의 대립에 대해서는 강력한 형사적 규제가 아닌 네티즌과 인터넷서비스운영자(ISP)의 자율적 노력과 정부의 법제도적 뒷받침을 통해 문제를 해결하는 것이 바람직하다고 하겠다. | Abstract
