Abstract
글로벌 무한 경쟁시대를 맞이하여 국내 보증시장의 실태를 조사함으로써 현재 적용되고 있는 하도급 계약이행 보증제도의 문제점 및 한계들을 분석하고 채권자(원수급자) 측면에서의 역차별 및 비대칭적 부작용들을 해소하여 보증 본연의 기능을 회복할 방안을 찾을 필요가 있어보인다. 전문건설공제조합과 서울보증보험(주) 2개의 거대 보증기관만이 국내 보증업무를 수행하는 독과점적 구조하에서 보증사고 발생시 보증채권자인 원수급자들이 보증받는 서비스 품질은 후진성을 면치 못하고 있는 실정이다. 이같은 문제점들을 개선해가는 방법에는 여러 가지가 있을수 있겠으나 기존 연구들에서 주로 다뤄왔던 법개정 및 보증회사 자체 개혁을 기대하기에는 절대적 시간 및 노력등이 장기 소요되거나 보증회사 및 전문건설업체 등의 반발로 실현성이 떨어질것으로 판단된다. 건설경기 장기 침체 및 최저가 입찰로 인한 마진감소 등으로 점차 수익이 악화되고 있는 현실속에서 건설프로젝트 성패여부의 가장 큰 비중을 차지하는 하도급 수행에 있어 계약불이행으로 인한 수많은 리스크를 헤징할수 있는 유일한 방편인 이행보증이 제 기능을 발휘하지 못한다면 하수급인의 부실이 원수급인의 부실로 전이되는 악순환이 지속될 것이다. 본 연구는 이처럼 불확실한 건설환경속에서 고객의 니즈를 만족할수 있는 보증조건을 스스로 요구하고, 이것이 건산법, 하도급법 및 공정거래법 등에 저촉되지 않는 범위내에서 합리적인 방안을 도출해내는 것이 원,하수급자 및 보증기관 모두가 상생할수 있는 길이라 생각한다.|In this era of infinite global competition, there seems to be a need to examine the realities of the domestic guarantee market in order to analyze the problems and limitations of the current subcontract performance guarantee system and find solutions to restore the original functions of the guarantee system by eliminating the reverse discrimination and asymmetric side effects in the perspective of the creditors (contractors). Under the monopolistic structure where the two huge companies, Korea Speciality Contractor Financial Cooperative and Seoul Guarantee Insurance, conduct all of the domestic guarantee business, the service that the creditor(contractor) receives is inevitably of low quality. There could be many ways to remedy these issues, but the constitutional amendments or reforms of the guarantee companies as suggested in earlier studies would require excessive time and effort or face resistance of the guarantee companies and small construction businesses. In the current market of long period of stagnation and diminishing margins due to choosing the lowest bidder, performance of the subcontractors determines the success or failure of the project. Inefficient subcontract guarantee systems would not allow the contractor risk to be hedged, causing a vicious cycle of improper subcontractors leading to main contractor failures.
