발주자 권력과 시공사 행동 관계에서 계약의 매개적 기능에 관한 연구

Abstract

건설 프로젝트를 성공하기 위해서는 핵심 이해관계자인 발주자와 시공사의 협력적 관계가 무엇보다 중요하다. 거래 상대방의 행동에 영향을 미치거나 통제 할 수 있는 권력은 건설 프로젝트에서 이해관계자간에 협력적인 행동을 유발 할 수 있는 요소로 간주 될 수 있다. 또한, 거래 비용 이론에 따르면 계약은 효과적으로 거래 상대방의 행동에 영향을 미친다. 권력에 추가하여 계약 또한 시공자의 협력적 행동을 설명 할 수 있는 요소라고 할 수 있다. 건설 프로젝트에서 시공사의 협력적 행동을 유발하기 위해 발주자의 권력이 유효한 영향력을 미치는지는 매우 흥미로운 주제이다. 한편, 계약의 기능에 대한 심층적인 이해는 성공적인 건설 프로젝트 관리에 있어 필수적인 부분이다. 본 연구에서는 국내 건설 프로젝트에서 발주자의 권력 및 계약의 기능과 시공자의 행동 사이의 매커니즘을 탐색 해 보고자 한다. Normally there is a one-time relationship between stakeholders in the construction projects. Thus, project participants are easily exposed to opportunistic behavior. According to the theory of transaction costs, a contract effectively influence the behavior of counter-party. The important role of contracts in limiting opponent opportunistic behavior has been academically acknowledged and studied in inter-firm relationships. The purpose of this study is to reveal the mediating effect of the contract on the power of the contractor in the contractor’s behavior. Power is divided into mediated and non-mediated power. We surveyed construction companies’ employees who have conducted construction projects. Based on the questionnaire response, we examined the influence of the Employer’s power on the behavior of the contractor. Both non-mediated power and mediated power were significant for in-role and out-role behaviors. Both non-mediated power and mediated power were found to have a significant effect on the control and coordination function of contracts. The results show that the control function of the contract is significant for the inrole behavior and the extra-role behavior. Finally, the mediating effect of the contract function was significant only in the control function.
