예술교육 관련 법령의 비교·분석: ｢문화예술교육 지원법｣을 중심으로

Abstract

본 논문은 예술교육과 관련한 우리나라의 제반 법령들을 비교·분석함으로써, 관련 법령 상호간의 문제점과 모순점 등을 발견하여 이에 관한 개선점을 찾아보고자 작성된 글이다(I). 이를 위해 우선 규범의 체계에 대한 기본적인 이해를 바탕으로 우리나라의 문화예술관련 법령 및 예술교육과 관련한 법령의 구성과 체계를 개관하였다(II). 예술교육과 관련한 가장 핵심적인 법률은 「문화예술교육 지원법」이다. 이에 따라 본 논문의 Ⅲ장에서는 「문화예술교육 지원법」에 관한 주요 내용을 살펴보았다. Ⅳ장에서는 「문화예술교육 지원법」과 예술교육과 관련된 다른 법령들을 구체적으로 비교해서 살펴보았다. 그러한 법률로는 「교육기본법」, 「문화예술진흥법」, 「문화산업진흥 기본법」, 「지방문화원진흥법」 등이다. 이러한 비교·분석을 통하여 예술교육과 관련한 여러 법령들 사이에 해당 규정의 불일치를 발견할 수 있었다. 이러한 문제점을 개선하기 위해서는 본 논문은 “예술교육”이라는 핵심어를 연결점으로 하여 관련 법령들에 대한 총체적인 점검을 통하여 상호 저촉되거나 불명확한 법률규정에 대한 전반적인 입법적 정비를 제안하였다. 또한 예술교육에 대한 지방자치단체의 관심을 촉구하면서 관련 조례 및 시행규칙의 제정이 필요함을 강조하였다(Ⅴ).This paper compared and analyzed Korean laws and regulations related to arts education. Through this, This paper aims to discover problems and inconsistencies among the related laws and to try to find some improvements (I).For this purpose, it outlines the constitution and system of laws and regulations in Korea related to culture education and arts education based on the basic understanding of the system of the norms (Ⅲ). To this end, part III of this paper examined the main contents of the 「Support for Arts and Culture Education Act」. In part IV of this paper 「Support for Arts and Culture Education Act」 was compared with other laws related to arts education in detail. Such laws include 「Framework Act on Education」, 「Culture and Arts Promotion Act」, 「Framework Act on the Promotion of Cultural Industries」, 「Promotion of Local Cultural Institute Act」 etc.. Through these comparisons and analyzes, this paper found disagreements among the various laws and regulations related to arts education. In order to solve these problems, this paper proposed the overall legislative maintenance of mutually contradictory or unambiguous legal provisions through a comprehensive examination of related laws, using the key word "arts education" as a connecting point. It also emphasized the need for the establishment of related municipal ordinances and enforcement rules while calling for the interest of local governments in arts education.
