Abstract
이 글에서는 법원과 헌법재판소가 2017년 선고한 노동판례 중 12개 판결을 선정하고, 이를 개별적 근로관계법과 집단적 노사관계법 영역으로 구분하여 검토하였다. 위 판결들의 중요한 쟁점은, 항공회사에서 용모규정과 국적차별 여부, 아파트경비원의 근로시간과 휴게시간, 성희롱 피해자 및 조력자에 대한 사업주의 책임, 용역업체의 교체와 묵시적 영업양도계약, 파견근로자 차별적 처우와 징벌적 손해배상, 고령자의 재고용과 기간제 근로에서 갱신기대권, 성과연봉제의 확대에서 절차와 취업규칙, 청원경찰의 근로3권 제한과 헌법 위반, 쟁의행위가 제한되는 주요방위산업체 종사근로자의 범위, 공무원노조와 단체교섭의 대상, 모바일투표와 쟁의행위 찬반투표, 공정대표의무의 범위와 차별의 증명책임 등이다. This article reviews 12 major decisions of the Supreme Court and the Constitutional Court on labor law in 2017. They are categorized according to employment law or labor relation law. The main issues of above case study are a dress code in airline company and discrimination of nationality, working hours and rest time of apartment guard, liability of business owners about victim and helper in sexual harassment, discriminatory treatment about temporary agency workers and exemplary damages, rehire of retirement age and renewal expectation right of fixed-term work, procedure and work rules for annual salary system of performance, restrict about basic labor rights of security policemen and violation of the constitution, the limit of application workers in major defense industrial companies that strike action is restricted, government employees union and object of collective bargaining, mobile voting and yeas or nays about strike action, scope of fair representation in bargaining representative union and burden of proof.
