저작권법상 수업목적 저작물의 이용과 보상금의 분배 - 설정출판권자 등에 대한 분배 가능성 및 미분배 보상금의 '공익목적 사용'을 중심으로 -

Abstract

본 논문의 목적은 저작권법에 따라 수업목적으로 저작물을 이용한 경우 그 보상금 의 분배에 관해 연구하는 것이다. 저작권법 제25조 제4항과 제31조 제5항은 일정한 요건을 갖추면 저작권이 제한된다고 규정하고 있다. 이때 저작권의 제한에 따라 저작 물을 이용하는 사람에게는 법정허락(statutory license)에 따른 저작권 보상금의 지급의 무가 생긴다. 이러한 보상금 지급의무에는 네 가지 유형이 있다. 첫째 교과용 도서 보 상금(제25조 제1항과 제4항), 둘째 수업목적 저작물 이용 보상금(제25조 제2항⋅제4 항), 셋째 수업지원목적 저작물 이용 보상금(제25조 제2항과 제4항), 넷째 도서관 보상 금(제31조 제5항)이다. 본 논문은 이러한 네 가지 유형 중 둘째 유형의 보상금만을 연 구 대상으로 한 것이다. 연구 대상은 크게 두 부분으로 나누어 ‘수업목적 저작물 이용 보상금의 설정출판권자 등에 대한 분배 가능성’(II)과 ‘미분배 보상금의 공익목적 사 용방안’(III)에 대해 검토한다. 이렇게 두 부분으로 나누어 검토하는 부분은 모두 수업 목적 저작물 이용 보상금을 둘러싸고 아직 해결하지 못한 문제점과 관련이 있다. 네 가지 유형의 저작권 보상금 중 특히 수업목적 저작물 이용 보상금을 둘러싸고 여전히 해명되지 않은 쟁점이 적지 않은 원인 중의 하나는 저작권법 제25조 제2항⋅제4항의 입법적 원점으로 되돌아가 제도 자체의 취지를 고찰하고 분석하는 입법사 내지 조문 성립사에 관한 연구의 부족에서 연유하는 바가 적지 않다고 생각한다. 본 논문이 이 러한 법제사적 관점, 그리고 이와 관련된 비교법적 관점의 연구에 하나의 단초가 되 었으면 한다.The purpose of this paper is to study the distribution of compensation in case of using copyrighted works for teaching purpose. Article 25 (4) and Article 31 (5) of the Copyright Act stipulate that copyright is limited if certain requirements are met. In such cases, a person who uses the copyrighted work under a copyright limitation will have a statutory license, which obliges him to pay compensation. There are four types of obligation to pay such compensation. First, it is the compensation that occurs when a work is in a school textbook pursuant to Article 25 (1) and (4) of the Copyright Act. Second, it is the compensation that arises when a copyrighted work is used for teaching purposes pursuant to Article 25 (2) and (4) of the Copyright Act. Third, it is the compensation that arises when a copyrighted work is used for the purpose of supporting the teaching according to Article 25 Clause (2) and (4) of the Copyright Act. Fourth, it is the compensation that arises when a work is used in the library pursuant to Article 31 (5) of the Copyright Act. Of these four types, this paper only deals with the second type of compensation. The subjects of the study are divided into two parts to examine “whether to distribute compensation to the publisher in the case of using a work for teaching purposes”(part II), and “how to use the non-distributable compensation for the public interest purposes”(part III). These two parts are all related to problems that have not yet been solved around the distribution of compensation in the case of using a work for teaching purposes. This is one of the reasons why we have not yet solved the problem of such compensation for teaching purpose. First of all, there was a lack of research on the history of the establishment of the statute of law, under which historical background the Article 25 (2) and (4) of the Copyright Act was made. Second, there is a lack of research on how to evaluate Article 25 (2) and (4) of the Copyright Act from a comparative perspective. I hope this paper will serve as a starting point for reflection on the lack of research so far.
