정부와 시민사회의 재정적 관계 : 지원에서 공조로 패러다임 전환

Abstract

이 논문은 정부와 시민사회의 재정적 관계가 상호 신뢰와 자율성을 바탕으로 동등한 파트너십으로 새로 정립되는 개선방안을 제안하는데 목적이 있다. 연구결과로 제시하는 파트너십 방안은 새로운 법률 제정이나 새로운 규정의 신설로 법의 시행을 모니터링하는 역할이 정부나 시민사회의 공조로 뒷받침되는 방안에 초점이 맞춰진다. 새로 도입중인 법률(공익증진을 위한 시민사회발전법) 제정이나 기존의 법률(비영리민간단체지원법)에 공조적 재정관계 조항의 신설로 이명박-박근혜 정부에서 국정농단의 사태로 번진 블랙/화이트리스트 불법정치나 관변단체 편향 지원의 정치를 차단하는 철저한 제도방안이 필요하다. 법률 규정이 마련되면 정부-시민사회의 재정 관계는 전통적인 ‘지원’에서 새로운 ‘공조’로 패러다임이 전환될 것으로 기대된다.This study amis to suggest a cooperative government-civil society partnership in the financial relations based on the principle of mutual trust and independence. This study suggests a partnership alternative that can be provided either by adopting a regulation clause in the newly formulating law(civil society promotion for public benefits) or by including a regulation clause in the existing law(governmental supporting for nonprofit organizations). The legal clause (to ban the discrimination of government institutions in financial supporting for nonprofit organizations and to promote equality in the supporting) is expected to eliminate the so called black list or white list politics during the previous governments (Lee Myong-park and Park Geun-hye). With the clause in the law, the financial relationship between government and civil society is expected to be shifted from the supporting to the cooperative paradigm.
