친환경기술의 기술이전 촉진을 위한 ‘패러다임’ 전환

Abstract

특허발명에 대한 접근권 향상을 위한 기술개발 및 이전과 관련된 TRIPS협정의 본래 취지는 지재권자의 권리 및 의무가 지재권 사용자의 권리 및 의무와 균형을 이루는 것에 있다. TRIPS협정체제는 일정한 경우 특허를 제한 할 수 있는 강제실시제도등의 안전장치를 두고 있어서 각 국가들에게 건강이나 환경을 지킬 수 있는 유연성을부여하고 있으나, 현실적으로는 이들 장치가 제대로 작동되지 않고 있다. 특허 보호는혁신을 촉진하는 효과가 있는 반면, 특허의 독점적 지위를 이용한 과도한 로열티의설정으로 인한 특허발명에 대한 접근 문제를 초래하고 있다. 특허보호와 혁신의 문제중심으로 이해하는 기존 논의 프레임에서 벗어나 인권이나 환경 등과 같은 시점을 추가하여 지식재산 보호의 유연성과 그러한 사회정책 수단을 통하여 의약품뿐만 아니라 친환경기술의 접근을 실현하는 방안을 모색할 필요가 있다.친환경기술을 둘러싼 남북갈등 문제를 해결하기 위해서는 우선 기본적인 기술이전의상황인식의 변화가 선행되어야 할 것이다. 특히, 친환경기술의 특허보호는 관련 기술의 개발을 촉진하는 기능을 가진 반면, 특허로 인한 시장 독점과 높은 로열티는 친환경기술에 대한 접근성을 제한하는 부작용을 초래할 수도 있다. 본 글은 환경문제의해결이라는 공공의 이익 관점에서 친환경기술에 대한 접근성 및 기술이전 촉진을 위한 국제적 논의 동향을 검토함으로써 정책적 함의를 도출하고자 한다.The rapid development and difssemination of environmentally sound technology is a key component of the global response to climate change. The innovation of the envirornmental technology industry is crucial to the well being of mankind. Intellectual property rights have traditionally been the primary policy mechanism for encouraging private investments in innovation. Global climate change negotiations have made some progress in the area of technology transfer, as reflected in last year’s agreement in Cancun to establish a Technology Mechanism under the UNFCCC. However, the technology transfer of environmentally sound technology has always remained divisive issue. On the reform of the TRIPS Agreement in regard of development and transfer of technology, developing countries are arguing for the amendment of the relevant provisions, whileas developed countries claim that the protection of IPRs is crucial to technology development and therefore are against amending the TRIPS Agreement.In this paper we intend to review the Legal Issues on Intellectual Property Law under UNFCCC and the possibility of Technology Transfer of environmentally sound technology.We also suggests possible solutions for enhanced environmental technology transfer. First, I advocate in favor of a possible revision of TRIP and relevant law, it seems important that information is available to developing countries on the ways in which compulsory licenses have been provided for and used in developed and developing countries. Second We suggest that the creation of an environmental patents’ pool and patent commons would help to ensure access to key environmental technologies.
