글로벌 시대의 행정소송의 전망과 과제

Abstract

근대적 행정소송제도는 전국가적 자유와 권리를 가지는 개인과 항시 이러한 개인의 자유와 권리에 대한 침해가능성을 내포하는 국가 공권력을 대립시키는 이원적 구도로 이루어져 있었다. 글로벌 시대에서의 행정소송제도는 근대적 의미에서의 국가 공권력 행사에 의한 국민의 권리침해에 대한 구제기능을 넘어서서, 민주주의적 장치들에 의해 해결되지 못하거나 불완전하게 해결되는 공동체의 중요한 문제들이 논의되고 걸러지는 또 하나의 장이 되어야 한다. 나아가 국가권력외의 권력들도 공동체의 질서형성에 함께 참여하는 협치의 시대, Governance의 시대에서는 Governance에 함께 참여하는 사회적으로 중요한 단체들의 의사결정도 법적으로 재검토(judicial review)할 수 있는 공론장(Public Forum)의 기능도 아울러 수행해야 할 것이다. 이러한 역할과 과제를 수행하기 위해서 현행법에 비하여 행정소송의 종류를 추가하여 권리구제의 흠결영역을 보완하고, 민사소송과 관계에서 행정소송의 역할을 확대할 뿐만 아니라, 항고소송의 대상적격과 원고적격을 확대하여야 한다. 특히 원고적격 분야에서는 공권론의 잔재를 청산하고, 단체소송의 원고적격을 확대해야 한다. 협의의 소의 이익도 확대하고, 미흡한 가구제 제도를 보완해야 할 것이다. 소송제도에 대한 이러한 보완을 통해서 여러 이해관계자들의 권리와 이익을 공익의 장에서 융합 · 조화시킬 수 있는 보완적 공론장으로서 기능이 오늘날 행정소송제도가 요청받고 있는 시대적 과제라 할 것이다.Modern administrative litigation system is under the confrontational structure between the freedom and rights of individuals and govermental powers. The administrative litigation system in the era of globalization must be the Public Forum, in which the important social problems could be discussed and determineded beyond the relief function. It can supplement the limits of democracy. To perform these roles the type of administrative litigation should be added to. Compared to the civil action the role of administrative litigation should be expanded. Therefore the scope and range of administrative action and standing also should be expanded. It is necessary that the judicial review system must be the Public Forum, in which the public interest and the rights and interests of the individuals harmonizes.
