부서제도에 대한 헌법적 고찰

Abstract

Since the Korean Constitution of 1948, the constitution of the Republic of Korea has enacted “the Countersignature” in Article 82. Although the provision continued for a long time in the Constitution, there is the conflict between the Korean National Assembly and the Government surrounding the countersignature. the Korean National Assembly tried to control the President by strengthening the countersignature authority of the Prime Minister. On the contrary, the President violates Article 82 of the Korean Constitution by exercising his authority without the countersignature. Likewise, the President makes the final signing after countersignature of the Prime Minister in the practical legal process in the government, though the provisions of the 「Act on Proclamation of Law and Others」 order that the Prime Minister shall make the countersignature after the signing of the President. This study re-evaluates the meaning of the countersignature in the Korean Constitution by summarizing history of the countersignature and comparing the countersignature of other countries such as USA, Japan, Germany, France, Austria This study may help discuss the countersignature in the constitutional revision process.; 현행 헌법 제82조에서 규정하고 있는 부서제도는 제헌헌법 이래로 우리헌법의 내용으로 이어져오고 있다. 오늘날 부서제도를 둘러싸고 국회와 정부간에 충돌이 존재한다. 국회는 국무총리가 가지는 부서권한을 강화함으로써 대통령을 견제하고자 하고, 정부는 헌법 제82조와 이를 구체화한 '법률 등 공포에 관한 법률'을 위반함으로 부서제도의 규범력을 약화시키고 있다. 개헌을 앞두고 있는 이 때에, 대통령제를 취하고 있는 우리 헌법에서 부서제도가 가질 수 있는 의미를 검토해보고, 개헌에 따라 부서제도의 의미가 어떻게 변화될 수 있는지를 예측해 본다. 이를 위하여 프랑스와 영국에서의 입헌군주제를 중심으로 부서제도와 장관책임과의 연관성에 대하여 살펴보고, 미국, 일본, 독일, 프랑스, 오스트리아를 중심으로 각 정부형태에 따라서 부서제도가 어떤 의미를 가지는 지를 검토한다.
