공공갈등 해결을 위한 국가공론위원회법 제정에 관한 연구

Abstract

갈등은 어느 사회에나 있다. 특히 민주주의가 성숙되면서 공공부문에서 다양한 갈등이 표출되고 있다. 최근 수년간 다양한 공공갈등 사건이 발생하였다. 예컨대 김대중 정부시절의 새만금 간척사업 갈등, 영월 동강댐 갈등, 노무현 정부시절의 부안 방사성폐기물 처리장 건설 갈등, 이명박 정부시절의 동남권 신공항사업 갈등, 제주 해군기지 건설사업 갈등, 4대강 정비사업 갈등 등이 그것이다. 국책 사업은 주로 정부와 주민 간 갈등으로 출발하지만 때로는 중앙정부와 지방정부간 갈등, 지역 사회 내 주민 간 갈등으로 까지 발전하기도 한다. 이러한 공공갈등은 지역사회 공동체의 조화를 붕괴시킴으로써 지역사회 자체를 파괴하고, 여ㆍ야 정치권의 갈등으로 확대되면서 사회통합을 저해하는 중요한 요인으로 작용하기도 한다. 이렇게 공공갈등이 사회에 두드러지게 나타나는 이유는 공공정책이 수많은 이해관계와 관련되어 있고, 그 이해관계에 커다란 변화를 가져오기 때문이다. 우리 사회에는 깊고 해결되지 아니하는 사회갈등을 해결하는 유효하고 적절한 방법이 마련되어 있지 아니하다. 이 연구에서는 다양한 사회적 이슈에 관한 국가 공론을 다루는 공공갈등해결위원회법(국가공론위원회법)에 관한 제반 문제를 검토하는데, 우선 그 전제로서 우리나라의 민주적 특성을 반영한 갈등조정기제로의 소통의 의미와 한계를 논한(Ⅱ) 다음, 공공갈등의 발생원인 및 관리체계(Ⅲ) 그리고 현재 시행되고 있는 갈등조정기구의 현황(Ⅳ)을 살펴 본 다음, ?국가공론위원회법안?의 내용을 분석ㆍ검토(Ⅴ)해보았다. 이 법안에서 다루는 국가공론위원회는 프랑스의 갈등관리기구인 ‘국가공공토론위원회’(CNDP)를 모델로 한 것이다. 프랑스에서는 이 위원회의 활동으로 상당한 사회적 갈등을 해결하는 합리적인 갈등관리시스템으로 자리를 잡았다. 문제는 위원회의 독립성과 중립성 확보이다. 한편 국가공론위원회가 등장하는 이유는 대규모 국책사업이 점차 많아지고 있기 때문이고 여기에는 정치권이 선거 때마다 국책사업에 대한 무분별한 공약을 남발한 것이 원인이라는 점을 생각한다면 위원회의 기능이 제대로 작동하기 위해서는 먼저 무분별한 공약 남발이 없어야 하겠다.The conflict is even in any society. Specially as a mature democracy, the public sector has been expressed in various conflicts. In recent years, various public conflicts events occurred. For example 4 Rivers Construction conflict, Naval base construction conflict in MB government, Saemangeum reclamation project conflict in DJ government etc. National projects, primarily conflicts in government and state civil starts. Sometimes, the conflict between the central government and the local government, may share and develop to civil conflicts within the community. These public conflicts disrupt the harmony of the community and for the community itself may be destroyed. Political conflict between the ruling and opposition parties expanded to inhibit social integration may be an important factor. This public conflict appear prominently on society because public policy is associated with numerous interests, and those interests is bringing big changes. The most effective way of managing conflict and appropriate manner is to meet the interests through “negotiations and coordination”. Because valid and appropriate methods to address the public conflict is not established in society conflict is continuously deepening and not resolved. In this study, I intend to review Public Conflict Resolution Commission Act enacted for the national public opinion on various issues relating to. First, by premise of this study, reflecting the characteristics of a democratic South Korea, I will discuss the meaning and limits of communication as conflict resolution mechanisms(Ⅱ). and the causes of conflict and public management systems(Ⅲ), the status of conflict resolution mechanism that is currently in effect(Ⅳ) and analysis and review National Public Opinion Commission Act(Ⅴ).
