언론의 오래된 기사로 인한 피해 구제근간으로서 '잊혀질 권리에 대한 연구

Abstract

미디어 환경의 변화는 쌍방향성을 기반으로 한 매체인 인터넷과 SNS 등을 중심으로 한 새로운 커뮤니케이션 질서를 가져왔다. 이는 민주주의의 근간이 되는 자유로운 커뮤니케이션의 확대라는 측면에서 장점이지만 개인의 정보가 쉽게 유출되고 이를 통제하기 어렵다는 문제점을 낳는다. 이러한 미디어 환경의 변화는 저널리즘 영역에서도 많은 변화를 초래하였다. 무엇보다 일단 인터넷에 기사가 게재되면 인터넷의 기술적 특성으로 인하여 망각되지 않고 어딘가에 남아있다 검색될 수 있다. 이러한 점에 근거하여 본 연구에서는 저널리즘 영역에 있어 표현의 자유와 개인의 인격권 간의 해결 방식으로서의 잊혀질 권리의 가능성에 대해 탐구해 보고자 하였다.특히 인터넷에 게재된 언론의 오래된 기사로 인한 피해 구제의 근거로서 잊혀질 권리가 어떻게 적용될 수 있는지에 대해 살펴보고자 하였다. 이를 위해 기존연구에서 나타난 잊혀질 권리의 개념과 법 적용상의 특성을 살펴보고, 온라인 매체에 있어서 언론중재제도가 어떻게 적용되고 있는지를 분석하였다. 분석의 결과 다음과 같은 사실이 드러났다. 첫째, 저널리즘 영역에서의 잊혀질 권리에 대해 적용될 수 있는 현행 법 규정에 대한 분석을 실시한 결과 현행 법 규정들이 서로 충돌하고 있어 해결방안이 도출되기 어렵다는 것을 알 수 있었다. 둘째, 저널리즘 영역에서의 법적 쟁점을 분석한 결과 오래된 기사로 인한 피해는 헌법 등에서 금지하고 있는 이중처벌의 효과를 가져올 수 있기 때문에 이의 피해를 예방할 장치의필요성이 있는 것으로 나타났다. 셋째, 언론중재위원회의 조정 결과 중 인터넷 신문과 인터넷 뉴스 서비스를 대상으로 한 사례들을 분석한 결과 삭제를 합의한 경우가 꽤 있는 것으로 나타났다. 기사 삭제를 조정 및 취하로 합의한 경우의 대부분은 사실이 아닌 것에 대한 보도가 이루어졌을 때 인 것으로 나타났다. 결론적으로 향후 온라인에서의 개인의 인격권의 피해구제를 위한 법적인 장치가 마련될 가능성이 큰 것으로 보인다. 이러한 점에서 언론사와 온라인서비스제공자(OSP)는 자율적인 내부규정을 설정하고 독자권익위원회 등의 조직을 두어 과거 기사삭제에 대한 준비를 할 필요가 있을 것으로 판단된다. 특히 유럽의 경우에서처럼 우리나라에서도 개인적 기본권들 간의 비교형량이 이루어질 수 있도록 법체계의 정립이 불가피할 것으로 판단되므로 언론사들도 자율적인 구제의 기준과 방안을 마련해야 할 것으로 보인다.Drastic changes in media environments have established a new communication order. These changes, on the one hand, enhanced free and two-way communication among people, on the other hand, they raised some critical problems such as loss of controlling personal information. These changes also caused some problems in journalism area. More than anything else, once the news articles are up-roaded on the net, they cannot be deleted, with being somewhere on the net without being forgotten. Based on this understanding, this study explored the possibility of applying the right to be forgotten as a remedy for damage caused by old news articles on the net. For this, this study firstly examined the characteristics of current law provisions to make a balance between freedom of the press and person’s rights for their character. Then, it analyzed the cases of the press arbitration and mediation which were decided for the deletion of news articles. Through the analysis, it was found that first, current law provisions are somewhat collide each other and cannot stand together, it is almost impossible to resolve problems that arise from the distinguishing feature of the internet. Therefore, it can be said that some new legal measures should be arranged to redress the damages by the old news articles on the net. Second, it discovered that the old news articles, if they are related with crime, can humiliate the related person and his/her families for a very long time. In other words, the old news articles on the net can impose mental pain of the related people with the news, which can violate the right not to be punished again for the same charge. Third, it is revealed that the deletion of the news articles on the net has already been considered as an effective way of recovery for the damages by the news articles on the net. However, the Press Arbitration Law puts a time limit(6 months from the publication) for the recovery. In conclusion, as is the case in the foreign countries, it seems that Korean government will be able to consider legislation for the right to be forgotten in the near future. However, the more important thing for the balance between the press and the people is that the press should take voluntary actions into account.
